Nope. FMCSA doesn't care about compensation.
Well, that's in regards to doing motor carrier work. Working for a non-motor carrier (2nd job) does matter.
Question 10: How does compensation relate to on-duty time?
Guidance: The fact that a driver is paid for a period of time does not always establish that the driver was on-duty for the purposes of part 395 during that period of time. A driver may be relieved of duty under certain conditions and still be paid.

I’m paid hourly now and still have to take the 30 minute taco break. I have no problem with it.

been in west TX for over 6 years with the same company, haul fuel everyday. our 30 min break is unpaid for those of us drivers that run under the federal hours. the drivers that run under the TX hours dont have to take the break. that the one major gripe i have with my employer, is some drivers are federal, some drivers are tx hours of service.
