The other night I was driving through a construction zone. Only one lane of the interstate was open. I was being tailgaited like crazy. I couldn't even judge how close he was cause the only thing I saw were the outlines of his beams on each side of my mirrors. Long story short, I was so focused on trying to figure out where he was that I accidently took out one of those tall plastic construction delineators with my trailer tires, and it may have struck the vehicle that was tailgaiting me. I know for a fact that I hit the delineator, and I am certain it probably struck the vehicle behind me. My question is, is it technically my fault? I no longer saw him after that, and there were no offramps for another few miles. I even slowed down, but I still never saw him again. My trailer was clearly marked with my company logo, and nobody questioned me when I got back.
I wouldn't worry about it. It serves him right for tailgating. If anything is said just say it was laying in the road and you thought you missed it. After all it was dark out. They are plastic and are designed to do minimal damage if any. It probably went under his truck and he started dragging it, so he had to stop. Don't let idiots like him bother you. Focus on your driving.
i had a AZ highway pa-troll on my donkey once,trying to find something to chase. He did this for couple miles, and i ran over a gator with my trailer tandems, and next thing i saw was black and white with cracked windshield get onto the shoulder real quick..... Too bad my tax dollars bought a new windshield for that car
The first bit of advice my dad gave me when I started to drive a car was " don't worry about what's behind you worry about what's in front, unless you have to turn or change lanes" I have not had an accident in 35 years from listening to that advice. I have been over taken too many times to count.
I've never understood why a driver would even be worried about someone tailgating you?? Please explain to me WHY it matters if someone tailgates you!!
Next time slow down at a barely imperceptible pace until the next exit, as if you're experiencing power problems of some sort. You're concerned the driver behind you is perhaps DUI or has a stuck accelerator, because they're following so close.

Good! A motorcyclist, in Indy, was killed last night when he hit an orange barrel that had been knocked out into the road. Glad you weren't there
