Stolen MC#

    I received an email stating that I did not turn in paperwork for a certain load. When I contacted the company and told them that I never hauled that load for them they asked to verify an email that I don't have.

    I have no idea why they did not contact me initially when the load was first booked because on the rate confirmation it has my name and my company name and my phone number and my address and they had my email on file but for some reason they used this other person's email and no one contacted me... until contacting me saying they did not receive paperwork for the load.

    So I contacted them and I had to go round and round through their corporate extensions and I had to wait for someone to get back to me. So I spoke with someone this afternoon and it is now understood that someone used my MC number and my company name and they picked up this load and just stole it. It was not a high value load but I'm not exactly sure what it was. The person I spoke with seemed surprised anyone would even steal that whatever it was.

    So I called ooida and they recommended that I call the insurance company and let them know what happened so that if the broker tries to put a claim against me that the insurance company is already aware of it.

    So I have been on the phone with Progressive for the last hour and a half and they have transferred me multiple times although they were very polite and apologetic, and they were trying to figure out how exactly to document this because they had no idea what to do. After them going back and forth and round and round they decided that I should open a no pay claim. She said that it would be filed under "other".

    As we spoke I felt uneasy about to having anything that has to do with a claim on my record. What she was going to file is enough of a process that an adjuster would contact me and I would have to tell him there's no claim etc etc. Now at this point I declined to filing anything with them because I don't want anything on my insurance. I've had people tell me things shouldn't affect me and then all of the sudden you go to get another insurance or all the sudden some underwriter looks at it and says oh no no you had a claim so your rates are going up.

    At this point they did say to me perhaps I could file a police report in that state where that happened. And they did say that if the broker were to attempt to put a claim against me the adjuster would contact me first and if I had the police report that I filed it at least that shows that I had some documentation.

    My only issue in this at the moment is that I don't want it to affect my insurance. And I feel that somehow I need to do something now so that if they do attempt to put a claim against me or they do attempt to do whatever, I've taken the steps to cover myself.

    This also happened at a time that I took some time off, so I do not have any documentation that I was on another load somewhere at that time.

    If anyone has been through this or has any information that would help it would be greatly appreciated.

    That sucks. I have not dealt with that situation before so I don't have an exact answer for you, sorry. I can give you some general advice though.

    First, I agree you should make a report to law enforcement just to document what is happening. They can start an investigation (may not take the report seriously though). This would help if a claim is filed and could paint you in a positive light in case the broker decides to also file a police complaint. Last thing you want is to be looked at as a suspect.

    Second, document who you spoke with at Progressive so they can check the records if a claim does get filed. This will show you are being proactive. There really isn't anything you can do at this point to prevent a claim, third parties can bring action against you regardless of what you do in a preemptive manner.

    Lastly, check you CSA/SMS records often, at least monthly, for the next few months to make sure whoever stole the load isn't using your numbers on their truck and racking up violations.

    I am not sure if the FMCSA would consider issuing you replacement numbers. This would be a pain, causing you to redo all your broker/carrier agreements and much more but it would put your old number out of service to prevent the identity thief from using your company information again, at least without them looking up your new numbers.

    Wish I had a better answer for you. Unfortunately this type of theft is becoming more common.

    Do you have elog/proof that log shows where you were parked, engine hours/etc.
    Probably should file a police report, because you could be charged with stealing a load.

    Sorry to hear all that. Stole the Load! Wow! I had a similar thing happen to Me, about 5 yrs ago, while on hometime. Someone used my #s and booked multiple loads. Each time trying to get fuel advances. I had a few calls from Brokers/Carriers asking whether Loads had been delivered. Then I got a call for a fuel advance approval. That’s when I figured out what was happening. I always fill Contracts out, with fuel advances not allowed. The last call I got was from TQL. I explained the situation, and told them, I hoped they didn’t approve any cash advances. The Guy said yes,$1000, then just hung up on me. None of the Loads actually got picked up. I made a Local Police Report. Gave them all Brokers #s. I also had gotten the phone# that the calls were made from. I had asked a few of the Brokers/Carriers what the person sounded like. The answer was broken English. Police said it was a Burner phone, purchased in Chicagoland. I suspect it was one of the Idiots where I was parking my Truck at. I had a lot of problems with the cut throats that parked there. Someone saw my Truck was sitting for a while. That’s my theory. As for TQL, I had quit hauling for them quite a while before all this happened. Apparently it’s a common scam. They should have known better. I got desperate and called TQL on a Load about a year or two later. They said they no longer do Business with my Company. Nothing lost, but they apparently suspect I ripped them off. I don’t know, and really don’t care. Bunch of Yo Yos anyway. I would make a Local Police report, on top of whatever else you decide to do. It was an awful feeling, being violated. Similar to when our apartment was burglarized years ago. Sorry to hear it.

    Good friggin grief man is it really this easy to undo years and years of a mans hard work!? I am disgusted. This reminds me of the time a ohio trooper asked me why numbers showed as a california company. I said that sounds like something you should be explaining to me! He just shrugged it off and so did I.

    I did ask them if they got a fuel advance and the person I spoke with said no, but I don't know if they tried to get one.

    I will talk with them again on Monday and get all the information from them that I can turn over to the police.

    Ooida said for me to contact the Brokers that I'm set up with and give them a code did the lonely released lives to me if I give them that code. That's tough to call all of them I have a lot of Brokers I'm set up with.

    And also to check the FMCSA site to see if they actually have my numbers on their truck and they are getting inspections or violations.

    As long as I don't have any problems for it and my insurance is okay then it just is what it is.

    We need clear guidelines from the FMCSA on authority jacking!
