1099 legality for driver that picks their own loads and paid % of load?

    And just like trucking, too many other companies misclassify their employees illegally. Heck, the whole 'gig economy' could not work without doing this.

    Just the economics of this plan is bad ......so I am driving for you find 2.60 to go to Denver so you have 1.00 aprox to cover fuel and all truck expenses sounds good right ....but doni take the load out of Denver or do I reposition myself at your expense to get another high paying load say all the way to at Louis ......now you have made nothing and he came out ahead and bossman that tire I ignored now has a flat...

    Eh, she actually prefers it that way. She can just sit and do her work and go home when done, meanwhile all the "real" employees have to waste their time going to motivational meetings and team building retreats and other such corporate cult nonsense

    That's ok, I'm not looking to get rich off somebody. I just want to break even on this one extra truck that I'm stuck with. TBH, I don't even really feel comfortable being a boss, I hate taking advantage of people and exploiting others. That's why I want to make it as fair and well paid as possible without actually losing a lot of money. Break even is the goal, any profit is just a side bonus if it happens.

    That is a bad plan for you and you are doing nothing for the driver long-term because that model will fail and is fraught with danger.....my opinion as a guy that owns a small fleet with zero turnover and very high morale sell this truck ...the rates are going to go through the floor and the truck will lose at least 1/3 of the value this year get ahead of the firesale this is your best chance to break even

    Also, I doubt most drivers would want to drive empty all the way to St. Louis making 0 money, even if I'm paying for the fuel (which is dirt cheap anyways, especially with huge landstar discount)

    I honestly I kind of want to keep it, because my other truck (the one I drive) is getting pretty old and I will probably need to switch sometime soon. But I don't want to leave the truck sitting for like a year because that will ruin it.

    Also, this plan worked just fine for a year-and-a-half. It's just my current driver is quitting for personal reasons

    So sell it sir , cash is King during a depression think of these rates with half the current rates , fuel comes up 30% and even the best driver will get lower mpg and higher maint then you did ....a good business model makes money for you the driver and the business and throwing someone into landstars system with no guidelines or rules could end very very very badly ....

    If she sets her hours she may be an IC then. That's why there is a 20 point list to determine. Any one thing doesn't make one an employee vs. IC. It's whatever the job falls into after going through the checklist and determining.
    Stop focusing on one single point, it's much more complex then that. And what another company either gets away with, or even be legal with doesn't apply to your situation.
