Let's say you're in your personal vehicle and cruising down a dark back road when all of a sudden a hobo is walking on the side of the street and you end up hitting him. You can clearly tell it's a hobo due to his dirty clothes and he's pushing a shopping cart. He is walking on the side of the street with no safety vest or any kind of safety equipment.
You did not see him because you were turning into a sharp curve . You end up running over his foot. If you call the cops and tell them that you ran over someone's foot, you will lose your license and the incident will go on your record as a felony.
What would you do from this point? If there were no cameras around or any Witnesses other than the hobo walking on the side of the road in the middle of nowhere with no lights, would you keep driving or would you report that you hit the man's foot and suffer the consequences of suspended license, a blemished driving record and the incident listed as a felony?
What would you do in this situation if it happened to you?

Running over/hitting someone is not a crime in itself, Its the subsequent investigation that may determine if a criminal action was committed. Texting while driving, drinking, etc.

Knew a kid when I was in high school that ran over a guy that was lying in the road in all dark clothing late at night... The kid felt a bump but hadnt seen anything... He though it might have been a livestock animal. So he stopped and backed up looking for a dead cow, sheep, or possibly a dog. He again felt a bump as the rear tire run over the guy again. The kid stopped got out with a flashlight and discovered it was a man... Very obviously dead, scared the hell out of the kid. He ran 1/2 mile to a nearby house and woke the owners up to use the phone to call the cops.
In the end it turned out that the guy had already been dead when the kid ran him over. But the cops told him that had he just drove away and not notified the police it would have been very hard to prove that he hadnt hit a living person and left the scene... Especially if it was several hours before the body was found. I'm not sure if the body was ever identified... But as I remember it was assumed that the deceased had been homeless.

i think paying attention is paramount to the RESPONSIBILITY to having the PRIVILEGE to drive on the roads. a persons "station" in life has NO BEARING on what the right thing to do is.
and believe me, no matter how dark any road is, someone, or something is always watching.
further, are there laws on the books that a safety vest IS REQUIRED of all pedestrians? i never saw one.
since you did this (or are you asking for a friend??), get a lawyer, and let him/her handle this, and NEVER...EVER....drive away from an accident.....cuz THEN you stand to LOSE EVERYTHING........
