Oh no! Another "PC to a truck stop thread"!!

    Yes I do have a question about this. I was told it was to be used in case you get held up at a shipper or receiver and they won't let you stay on site.

    Well tonight my dispatcher lied to me and told me this place allowed overnight parking. I told him I can't get there safely with the drive time I have and he said just try. So I did. I drove into their parking lot with A SINGLE MINUTE of drive time left.

    Well low and behold I don't have any drive time to get out and I have to PC to a parking place. I told them that they are abusing the loophole because I knew good and well I didn't have any extra time to get out when I went in and that's not what this PC thing is for. I was told that it's only if something unforseen happens and it takes them a longer than usual amount of time to get you loaded or unloaded. They had me loaded in 20 minutes flat. So it was not on them. But on me.

    So what is the deal about this? If you show up with 1 minute of drive time to a shipper that won't let you stay, you knew good and well that you would be out of time at this place.....is that a legal use of this PC thing or is that pushing it? I feel like it's a violation if the DOT can show that you knew you had no time left when you got there. No reasonable time left. One minute is not reasonable.

    As far as dot goes, you showed up at a place to load that you were told you could take your 10 at. When they made you leave you went PC to a safe place to park. Perfectly within the PC guidance, the way I see. it.

    No reasonable cop will bust you for it. Now if you get Barney Fife with an axe to grind, take the ticket, not a warning ticket and go to court.

    Dispatch might have thought you could shut down, things might have changed, always get those conversations on the qualcomm or tablet so you can cya, lots of companies now have rules that are stricter than DOT,the company I was with you couldn't be under a load or have trailer attached to use pc.

    My safety says you can use personal conveyance as long as you are not advancing your load or heading for your next pick up. For example, one time I ran out of time before I could get to a stop but was allowed to use pc to double back (away from the load destination) to get to a rest area.

    And doubling back is fine if that rest area was closer to you than the next one would be in your direction of travel.

    Just comment on your PC "asked to leave customer property, driving to safe parking". No trooper is ever going to give a dang about that.

    As far as your dispatcher's advice, hes going off of notes that are listed in the customer profile of whatever system they're using. Those notes are provided by drivers. Dont know if you've noticed yet, but the vast majority of your fellow drivers are idiots.

    Your safety department is wrong. There is no guidance for that.
    There are two, and only two ways to move the truck on PC and not be truely personal as per the guidance. One is being told to move by an leo, and the other is getting kicked out of a shipper/receiver. All other reasons are for truly personal moves like food, groceries and such.
    Now will you get in trouble? Unlikely, just be aware that it's 100% up to the leo at that point.

    As for the op, the guidance specifically allows that sort of move.

    Examples of Appropriate Uses of a CMV While Off-duty for Personal Conveyance
    Time spent traveling to a nearby, reasonable, safe location to obtain required rest after loading or unloading. The time driving under personal conveyance must allow the driver adequate time to obtain the required rest in accordance with minimum off-duty periods under 49 CFR 395.3(a)(1) (property-carrying vehicles) or 395.5(a) (passenger-carrying vehicles) before returning to on-duty driving, and the resting location must be the first such location reasonably available.

    Yes, the distance to the rest area was the closest possible and I had to leave the receiver, in fact I was bobtail.
    However, I think this discussion really illustrates how vague the definition of PC is. Basically it has to pass the smell test for the auditors and/or a leo if you are unlucky enough to get pulled over in the middle of using it.
