Oh no! Another "PC to a truck stop thread"!!

    If your talking about being dispatch to pickup a load or deliver a load and not having enough time. My understanding is, at the time of dispatch if you don't have enough hours to make it to pick or deliver. That would be illegal. PC because we run out of hour a shipper or receiver is for unforseen circumstances. Dispatcing someone knowing you don't have enough hours is illegal. Unless they have overnight parking. So if they normally have overnight parking but the night your their, they don't I believe it legal to use PC .

    Now trying to get them to stop doing that is problem because is kind grey area. My company would do the same thing and I would get forced into working 18+ hour day. Because once I was their it might take 3 hours to load or unload. Then they don't have any overnight parking. So I would have drive once empty to place to park.

    This guy says he attorney a seems to know the fine lines in trucking but how do stop a dispatcher or company that kinda goes into the grey are of HOS rules. I don't know. Maybe show them this video he explains stuff good.

    From my understanding and you watch that attorney guy in the video. He claim if they knowingly send driver to pickup or deliver a load and they know you will run out of HOS and the don't have overnight parking that illegal. If the think they have overnight parking it probably legal. If you get their and they don't have overnight parking. I had this happen to me. Dispatch saying they have overnight parking. When I got empty they said no overnight parking. You can use PC to first safe place to park.

    They key is, they are not supposed to dispatch a driver knowing you will run out of HOS or not having enough HOS to complete the run. I think that's how if anything goes wrong you can basically get the dispatcher/ trucking company on the hook. Because if they dispatch someone and know they can't complete the trip. That's illegal from the start. Unless they think their is overnight parking.

    I love those rest areas that say no overnight parking. Pull into one of those, go to PC because you can't legally park there. At night that might give you another couple hours on PC driving looking for a place that you can legally park.

    The answer to the question is easy, stop the truck and go to bed.
    Are most drivers so scared that they cannot make up there own minds anymore? I guess us men have lost what god gave us or put them in some companies drawer somewhere. I ran 20 some odd years on loose leaf when there was no excuses of not making it on time. Now with the babysitter with me all times are stamped.
    This is not an issue, the info was wrong, p.c. out and don't look back. You're not abusing the time, it just didn't work out.

    Just PC to the closest place, not the closest place on route to your destination...

    Going to a hotel or a truck stop is fine on PC. If you are at a dock on duty then they get done and you need to park for the night at the next closest parking spot you can PC. If your rolling into a truck stop and parking for the night you can use PC. Your not advancing a load your parking for off duty time.

    Thank you everyone for your input. It seems there are as many different opinions about this as their are members.

    I did not log loading as on duty because I was not on duty loading. I hit the dock, set the brakes, grabbed my dog and off we went. I come back to the truck when I can see the light turn green from where I was walking the dog. We have internal and external cameras in the truck that verify this is always what I do when I bump a dock. Only if they say I must remain in the truck do I stay. So that is very rarely.

    On duty loading is if you are responsible for the truck if the truck is being loaded. If you're absolved of all responsibility of the vehicle it is off duty. Same with sleeping in the bunk. If I'm sleeping waiting to be loaded I'm not on duty. Even against a dock.

    That being said, I started my 10 hour break AFTER I got parked after running PC. And someone asked how far I went. That day about 20 minutes. I've gone as far as an hour and a half PC to find a place to park.
