Has anyone experienced anything negative from a health questionnaire that a trucking company requires you fill out with your employment application to drive the truck there? Correct me if I am mistaken, but isn't it illegal for them to ask medical questions and/or require medical exam unless or until they actually make an offer of employment to you?

Sorry in advance if this should have been posted in another thread. I just assumed, that it probably isn't touched on in any other thread.

In all my 15 years of driving for mega carriers down to carriers with just two trucks, I have NEVER seen an employment application with a health questionnaire on it. Have you?

Thank you. I didnt think it was legal for this to be on an employment application. They didn't just ask can you perform essential functions. Asks about diabetes, among other things. Even asks for a list of medications youre currently taking. Wow. Thats a huge liability for them. Damages from the research I've done seem to be capped at $300,000. But that's not like $300,000 period for say a class action. That would be per plaintiff. Doubtful every single person who may not have been hired for answering would receive that much but imagine if they did. The carrier is private. It would be catastrophic to them for sure.

Trucking companies can get away with alot of crap long as they dont get caught has been my experience. I applied at a mega a few years ago and everything was going good untill they found out that I only have a one year medical card. Of course they don't tell you the reason they turn you down, they just say sorry, but we can't hire you.

    I will play devil’s advocate,,,
If they do hire you and find out that you are a diabetic or have a equilibrium problem preventing you from climbing onto a trailer. Or some other medical problems that can disqualify you. Then what?

I dont disagree with that at all. I think the purpose of the ADA and EEOC is to prevent you from not fair consideration for the position. Obviously if you're diabetic or have high blood pressure you may be wasting your time. In my particular instance I have an auto-immune condition that requires a very costly prescription. For all i know, they could refuse to hire me based on that alone. Its expensive. Like nearly $12,000 a month for 4 injections taken weekly. Otherwise no health issues. Two year medical cards always. This company apparently uses this to just give someone the cold shoulder i would imagine. But that's just me. Either way, they aren't supposed to ask those kinds of questions. Or so it seems.

Being diabetic should not disqualify anyone unless the are on insulin.

Shouldn’t care if it is a one year vs a two year card either.

Based on the job description, the question should read, "is there any reason that you cannot perform the duties as described in the job description?" Other wise if you pass the DOT physical, then you should be good to go.

Thats my sentiments as well. They think they're being slick. The questions alone will look bad on their part. Its on the applicant to make the allegation and up to the company to defend it. Cant claim they didnt break the law and maybe be a little discriminate when they did and its expressed blatantly on paper. Long process to go through with filing a complaint with the EEOC, have to wait for letter of right to sue. Then sue that company.
