I'm not saying it doesn't happen or that people don't get away with it because the customer doesn't question whether that can legally happen. My question is what was your plan if they had told you to f off and showed up with the spare keys and drove off anyway, or called the sheriff? How did the TA keep you from doing exactly that?

It only works on people who don’t know any better or people who believe truckstop counter stories. If they’ve done no work, or they’ve done work and you’ve paid them for what was done they can’t hold your property.

When you're in the shop and the tires are off.

    You're not going anywhere.

Okay, cool. I'll pay you what I we agreed on for diagnosis and you'll put them back on and I'll gtfo of here. If you refuse the cops will come and if you don't let it go then, that'll be theft or maybe coercion.

At that point it's a waiting game, who's losing more money with a car the customer can't afford to fix sitting apart on your lift?

Putting tires on isn't too hard. I'll do it myself if I have to.

I know a guy that had his truck deleted last march after non stop problems and down time , he put 11k into it in 10 months and still wasnt fixed .
Hasn't been in the shop since other than maintenance.
He doesent run cali anymore..nothing removed and zero smoke ...will never see a dealer again for any engine work .
Another friend had his maxxfarce deleted ..zero issues since .
I was steadfast against against deletes until recently but ya gotta draw a line sooner or later between bankruptcy and paying your taxes and child support.

Since you have to occasionally pass diesel emissions in Colo., eventually you will get caught. As for what will happen, via one of the Nissan clubs I'm part of, I'm aware of one guy with a Ram that got nailed for rolling coal, a CDPHE inspector happened to be nearby and noted his plates, he got the letter in the mail. Upon inspection the truck failed, it could not legally be driven on the street and was impounded till it could be towed to a shop. The fine was $10K and he had to bring it back into compliance before it could be registered again. Another friend works for Snap-On, he deals with a lot of these shops, and they are rightfully scared of the fines, which can be $10K per vehicle they modified. Diesel Brothers in Utah was fined $850,000, at present, you'll be on your own, as pretty everyone has stopped doing it. As for repairs, as others pointed out, good luck, not sure any shop will work on it.
