Lol. Well if they found it in an area thats not frequently used or not in your belongings and you havnt admitted to it, then you will have to go to court. They will charge you and then youll have to hire a lawyer. They have to prove you knew it was there. And if you havnt admitted to it, and it hidden somewhere you don't commly use and was not in your personal belongings, thats going to be kinda hard and I would imagine they will just drop the charge.
Why would the DA take a simple drug paraphernalia charge all the way to trial if wasnt a sure thing. And even if They win what would they get out of you? Its a simple misdemeanor charge... What will probably happen if you hire a lawyer and tell him your not pleading guilty and want to have a jury trial I bet the DA will drag it out as long as possible and then dismiss it.. Thats been my experience at least.truckdriver31, BackwoodsGA, Coffey and 1 other person Thank this. -
I know what a good lawyer/da will ask.
How long did you have the truck?
Then a lawyer will ask you this question, what were you acting like to make the cop do a physical inspection of the truck cab?truckdriver31, tommymonza, BackwoodsGA and 7 others Thank this. -

So where you charged with paraphernalia?
Were you sent for a mandatory drug test?
Will you pass it if you were?
Are you an O/O?
If you are a company driver, are you OTR or local?
Do you have an assigned truck or Do you "slip seat"
Where was the paraphernalia found?truckdriver31 and Sirscrapntruckalot Thank this. -
Doesn't matter if it was yours. You could have still used it. It was in your truck. Do you still have a job?
alds, truckdriver31, Opus and 3 others Thank this. -

Lets not assume anything guys. It dont matter how he looked or why they searched his truck... And the what ifs and could ofs dont legally matter.
Its possible it could of been someone else's of its a company truck or shares it or has shared it with someone else. Even if he didnt share it and is a OO he can still beat it.
Whos to say his mad gf didnt plant it there or a co worker who uses stashed it and forgot about it. It happens. And as long as OP didnt admit to it, then in say you got a good chance getting it dismissed. Trust me. Ive dealt with the court system several times. I know how it works. Theyll try to get you to plead to something bc they want money out of you with out having to spend money. Going to trial is very costly and time consuming for you and the DA.. Thats why I'm saying what would they gain even if they won? It would cost more to prosecute you than to just drop it.alds, truckdriver31, Coffey and 2 others Thank this.
