    Hi,

I know it's old news but I had a driver call me earlier today after being inspected by a DOT agent, he use personal conveyance if he's required to move the truck at a customer yard if he's in the middle of his 10 hour sleep, let's say to move from the dock or to the dock. Apparently, you can't do that and you need to use yard move but we all know that's not possible because that would require the driver to restart his 10 hours from scratch with is completely dumb.

Is there any truth to it? We didn't get fined or anything and he was actually allowed to go after pleading a little bit with the officer but I'm worried that in the future they might force some drivers to actually stop and do their 10 hours off duty cycle.

If I have a driver who is in SB at a customer's yard in the middle of his 10-hr reset he is then asked to move the truck within the facility - that driver is now back on duty while he moves the truck.

The only instances I can think of where it would be acceptable to move a truck while in the middle of a reset, and still use PC, would be if an officer was forcing the driver to move or if there was some sort of emergency condition that is unavoidable and explainable. Like a flash flood barreling down on you or somethin'.

If they were in SB for 2 hours. They could do the 8/2 split at least.

"To/from dock" : I would call that work. Legit work.

Edit: after reading original post one more time, it sounds like a recurring issue using pc at customers while allegedly taking a "break"...

He's "enhancing the operational readiness" of the truck. Why would it not be on duty?

Thanks, I know it's the "right" answer, we'll make it work with yard move if necessary.
