    Still, it is a raw deal when Swift plays one side against the other with the performance bonus and sign on deal.

    Shame on you Swift, for that!
    The one should not detract from the other.

    It sounds like Swift was awful in only one way, from your posts.
    It was the sign on bonus, and the fact that you would not get the performance bonus for a couple times because of it.

    I don't agree with what they did in this case. I think it is cop out on their part.
    Kind of like what all the politicians do every day in Washington.

    But overall they are not a bad company to work for.

    My pay at Swift was always as expected (no sign on bonus for me). But this does sound a bit shady, as most sign on bonuses are. I’ll bet most of their new recruits are bronze so it’s not a major issue for them. They should at least give you the option to pick the higher paying bonus between the two.

    Don't forget to come back and post when you go to court.....because we all need to know...anyway, I'm trying to see why your feelings are hurt. You got 2000 sign on bonus, and they are supposed to reward for being there 3 months? Think about this, chances are you ain't even eligible for benefits, and they are supposed to tack on total 3000 dollars between now and January? Many companies, mine included, don't even offer bonuses of any kind for real. Many companies make you stick around for a little but of time, before you can get quarterly bonuses...why? Because so many quit early, like you did. Its not they shorted you on the work you did, we are talking about a bonus, and you for real may lose this case. I'd say cut your losses and on to the next company.

    Well...I'd feel pretty cheated by this situation as well. My sign-on bonus makes me ineligible for a more lucrative safety bonus? Wtf? Laughable.

    You seem to be getting hung up on the fact that they use the word "bonus" to describe the quarterly pay. This quarterly pay is part of the regular pay package at Swift. It's not like a Xmas bonus or some other arbitrary (and voluntary) gift from the company. It's a guaranteed part of the pay package. Just because it isn't paid out weekly, or because the word "bonus" is used, that doesn't negate the employers obligation to pay someone for work already completed.

    Here's a hypothetical example that will demonstrate my point more clearly:
    Suppose a used car dealership hires a salesman. The pay package for that salesman, which is detailed in writing, states that they will receive $290 per week in base pay per week plus a bonus of 6% of the sales price of all cars sold during that month to be paid out in the second check the following month. If the salesman works the entire month then the company does not have the option of not paying out that commission simply because they used the word "bonus" to describe it. That would be just as illegal as not paying them their $290 for any given week.

    The short version is, if you promise an employee pay in writing as part of their compensation package and the employee performs the work in full, then you can't simply not pay them.

    Also, to be frank, the pay at Swift is below garbage. I would have quit over month ago if it weren't for the bonus. I stuck it out since I was only a month away from the first quarterly bonus despite how absolutely horrible everything was at Swift. I stuck it out and did the work and now they have to pay me. It's not an option.

    As for when you posted:

    What you don't understand is that Swift's base pay is around HALF what it would be at a normal company. They didn't tack on bonus pay as an extra perk. They separated this out from normal pay. It's not extra money. It's 5 cents per mile that they hold back until the end of the quarter. As a reminder, even with the bonus pay their total pay is a complete joke.

    Well.....I am not sure if the car sales man example compares. In any event, I'm making 50 cpm now, that's a competitive wage. You're saying Swift offers have that, and you're saying they hold back 5 cpm for a bonus, so you're telling me you working for 30 cpm give or take? That's an important piece info there......what was your cpm for 3 months you were working there? A bonus is never guaranteed, but you're saying they hold back a nickel a mile, then my question is why did you go forward with this, if you worked, then you should have got your money on payday, not quarterly. Were you a company driver, or did you lease?

    No he is a liar. He is not working for 30cpm. Swift starts out at .40 a mile and the quarterly bonus is anywhere from .5 to .8 cpm .. And every single driver gets atleast the .5cpm .... It sounds like he wasnt able to handle the job and wants to fight a multibillion dollar corporation who employs something like 50k or more people and basically runs the entire trucking industry , in small claims court, on his own , and thinks hes gonna win. When all they are gonna do is pull out the paper that he signed , waiving his right to be paid 2 quarters of bonuses because he took the sign on bonus....this is one of the documents they make u sign in orientation and if you dont read what you are signing then you end up in this position... thinking u are gonna take down a multibillion dollar corporation in small claims court...
