Need advice about a company not paying me.

    My approach to this is different.
    I'd deliver the load to Urbana, then, without calling them, take the truck and empty trailer to their terminal and leave/quit.
    Uber it to the bus station and go home to Iowa and start over.
    Cut your loses.

    You can't legally be an employee and also get paid a 1099 simultaneously. They can get in serious trouble with the IRS for misclassification. But since you are on a 1099 you're technically a subcontractor and subs can't get help from the state labor help for back pay. You'd have to sue them in small claims court for your money.

    You're an independent contractor, not an employee. With that said, I'd force them to fuel advance ALL money owed to me before I delivered that load AND I'd make sure I had enough fuel to get back to their yard after the delivery. If they don't comply take the load and drop it at their yard. Even if they do get you your money...quit after the delivery. Document everything and walk away!

    In the future stay away from companies like that. They're usually scumbag outfits only in the States on work visas. They don't care about fines or courts because they will be leaving once their visas expire. Usually Slavs, Volvos and 1099s.

    Can you swing by your home in Iowa and drop off your personal belongings before delivering in Urbana?

    I can almost guarantee you that a 1099 company doesn't subscribe to Dac, so nothing to worry about. Do what Chinatown said and del the load and then take truck back to them and quit.

    150% guarantee that these 1099 companies don't use DAC. Especially the companies out of the Chicago land area like the one you work for.

    I would park the truck at a truckstop near your home in Iowa and tell them to come get it.
