Take them to a small courts claim. If you have evidence of work the court will rule in your favor.

After court judgment if he doesn't pay you.

You could get a court order to get Bank Levy If you know the person has money, you may be able to get a bank levy, which is an order from a court to seize part of someone's bank account. Or property levy find out who the company is registered under.
One thing I forget to mention when you filing forms requesting bank Levy or liens of any type .
Don't disclose person's who owe you money their Bank name or location or the property information on the forms. very important.
The Bank Levy or liens request form is going to be forwarded to person who owe you money by the court to notified them of your request and ask them to come to court .
The person who owe you money can see what you asking.
if they notice you know their bank name & locations they will change it to different bank immediately . Rendering your request worthless.

When you get a bank Levy or liens judgment from the court . The judge will assign you a sheriff or you can request one. Take them to bank of person who owes you money . With the court order bank Levy bank will write you cashier check in amount of whatever money the judge order he owes you.

When your w2 job stiffs you for your last check I'll have no pity for you.

 

The difference being, at best, is if you are on a 1099 job you entered into a conspiracy to commit tax fraud. In most cases a w-2 is being legal.
If you are willing to, at the very least, help commit fraud , why should anyone feel sympathy? After all the owner of the trucking company is simply treating the driver as he treats everyone else. This should not come as a surprise.
