That is the reason AB5 will pass nationwide at some point.
Companies like JCT are walking the fringes of the law, it is also why the class action lawsuit by its former drivers has made it to trial.
You can argue all you like, but you will still be wrong.
A lease purchase from the company you drive for is not a legal 1099.

Most of the drivers that come on here complaining about these companies are not in a legal 1099 situation. They are forced dispatched, told when and where to run, and can't even take home time without getting permission, and otherwise treated like an employee driver would be treated. Many sign contracts without really knowing what is in them and many never even get a copy of the contract. Yes, I know, pretty stupid, but we see it here all the time. They end up with thousands held for an escrow account that there is no chance of ever getting back, and being charged back for maintenance and repair items on a truck they have no financial interest in. This is the kind of predatory thing that caused AB5 to be passed in the first place.
Yes, there are many 1099 positions that are legal. There are those that book their own loads and set their own schedules. But most of the ones that come on here crying about getting the shaft aren't even close to legal and the IRS has been hitting them hard.mjd4277, REO6205, Dale thompson and 1 other person Thank this. -
