Here is the story per driver :
Backed in for unloading , door was wide open all the time , construction co was doing wiring for lighting doing piping and left one pipe hanging , after unloading driver was driving out and that pipe cut tarping system open .
Is it construction co fault ?! Should they be liable for this or its totally driver fault .i think its construction co fault , we decided to wait till morning and talk to supervisor and see what the outcome be .

I would say it's the driver. If the piping fell on the truck it would be the construction company. With it being a stationary object the driver should have seen it.
Unless I read it wrong and the pipe wasn't stationary...

Is this the same driver that you have had some issues with previously?

    What did the supervisor say?

    C'mon Pav, don't leave us hanging!!! :)

I normally dont wait for second time issues !:)
Supervisor said : we have to investigate this issue and his story was : we did find out only when all happened , driver was pulling out and happened to be very close to the scissor lift with some pipes inside that made damage .
Its clearly drivers fault and unfortunate situation for the equipment owner :) , damages probably in $1000 range replacing the tarp panel , problem is that he is so far away and without proper securement it can cause even more damage , at the moment conestoga strapped to the front headboard with 5 straps and truck is heading toward home as regular flat for repair .... Not sure if i can take it anymore ...

Sorry to hear this. Ya, for me 1 truck I drive is enough headaches, I dont know how you guys deal with owning a couple trucks... lol.

Maybe you should remove the conestoga and give the driver some 8 foot drop tarps :)

Have enough drivers and the good ones make up for the few bad ones. About the time you have them all filled with good guys one or two will go buy their own or retire. Then you start again.

It's great experience if you ever want to open a daycare.
