Nice answers guys. The reality is that ANY type of coercion by a company (large or small) for a driver to violate HOS or engage in any unsafe behavior is a BIG RED FLAG.
I worked for a company that highly "encouraged" the questionable usage of the agricultural exemption even though it would turn a 14 hour duty day into a de facto 17 hour duty day, and an 11 hour driving day into a 14 or 17 hour driving day if there was a way to book-end the ag exemption to each side of the normal driving day.
It wasn't a game I was willing to play with my CDL, my safety (driving fatigued), or the safety of the person I might kill because I was driving tired and letting myself get bullied into doing anything I knew to be unsafe. I wouldn't do it.
Any time I got one of those calls/texts from the dispatcher I would respond "I can't make it in my available HOS, reschedule p/u or delivery to legal HOS" then I would give a reasonable time where I could legally and safely make it.
He was so stupid he would actually reply with "If you're late I lose money" or "Let's see how you like getting 1000 miles a week" or "If that don't work for you bring the truck to the yard and get off"...as if HIM losing money was my problem or any reason for ME to break the law or do anything unsafe or questionable. The threat of getting off the truck was no big deal for me...I could always afford to rent an SUV or minivan to get home from wherever I was. Noobs probably won't be in that financial position.
I decided then and there that I was done with that company as soon as I got back home to AZ (they are out of Logan, Utah) and I was going to do my unload at the customer, and unload my personal stuff when I got to the drop yard and hand over the keys to the truck to the guy who did the local runs.
I did my run from Twin Falls, ID...a reefer of tomatoes...to Phoenix ALL within legal/safe HOS then had my wife meet me at the drop yard with my pickup, and unloaded my stuff. Done and done at the first sign of coercion. The company never pays for what they try to force a driver to do...it's all on your shoulders.The_Great_Corn, 36 and out, Vampire and 2 others Thank this. -
