Violated hos, company wants me to sign a form? should i be worried?

    Company said its not bad its just a warning form, but will that mean they are going to fire me in the future? i hope not i really like this job.

    Company is covering their backside it’s standard procedure . If company begged me to push it close and I went over by a few minutes I sign A dispatchers name if they weren’t paying attention .

    So what was the violation and what is the form they want you to sign?

    I am watching M.A.S.H. on Hulu.
    In one episode someone brought up the fact that the shrink never signed a loyalty oath form.
    His reply was something like...
    'The enemy would have no problem signing that form, because it means nothing from that end.'
    Rather like swearing an oath of honesty on a book that you do not believe in.

    I was once written up for something and it went into my file.
    I never signed it because I didn't even know about it until a year or so later.
    But for something like that to go on record, I believe it has to be signed by me. ?
    I had been 'officially' reprimanded without me actually knowing about it. Go figure.
    (Not HOS. It was my idle time. Right? And it is still high at my 10 year mark with this same company.)

    It is all much to do about nothing, if you are doing your job correctly - for the most part.
    If you violated HOS and they caught you and are complaining about it, that is a good thing.
    They do not want you violating HOS.
    Better that than a company that pushes you to make violations.

    So learn from it and simply plan your time and trips better so it does not happen again.

    Part of that planning is learning to say NO when you need to.
    The planners do not care about you in the least. They only want to cover loads.
    But if you feel that you can not do a load safely and on time within your own hours of duty, you need to simply say no.

    You're fine, this is a measure they implement so that in event of an audit or other events they have proof of trying to mitigate behaviors. Listen to them, read what they are giving you, and apply the experience. We've all bent and broken rules, and we've all learned what doing those things mean in the long run.

    I have heard carrier safety critters have actually wet their diapers when an FMCSA auditor identifies themselves. When they audit a carrier they will ask to see the data required by parts 391 and 395. In most situations, they have a "hit list" of drivers and go check their driver qualification files and then their HOS records. The FMCSA expects to see some HOS violations, it happens. What they look for, however, is the documentation the carrier spoke to the driver about the violation. These forms are how some carriers do this. A HOS violation will not result in your photo being put up in a post office, but a carrier risks a shutdown order if they continue to allow drivers to violate HOS rules.

    It allows the carrier to show DOT “you got a talking to” when the DOT comes around.

    CYA paper.

    don’t sweat the small stuff. Focus on not hitting things and not getting tickets.

    Once spoke to an actual auditor who stated that they are not concerned about an occasional 5 or 10 minute violation by a driver. They will get excited about patterns and repeatedly violating the rules though.
