    Bard Transport Inc. The owner of the company put more money in the 1099 than he really paid me. How can I report that? Any help please.

    I would contact the IRS. Do you have check stubs and/or direct deposit records, bank statements etc. that will back you up? And make sure you also file a complaint against him for illegally paying on you on a 1099 to begin with.

    Is it illegal to be paid on 1099 as a driver? If so, since when?

    I know it is not in the best interest of the driver to be paid that way...to the best of my knowledge it isn't illegal is it?

    There are tests that the IRS has to determine whether someone is, or is not, an independent contractor. If he works the same as a w2 driver, then he probably is not a contractor. If he can't pick and choose the loads he runs, and determine his own start times among other things, then he probably is not a contractor. All this and more must be spelled out it detail in the contract he signed, and received a copy of, before he started his job.
    If he files a complaint with the IRS, they will investigate. If they determine the employer is in violation, they will make the employer pay the employers taxes, Social Security etc for all of the people they have been running as 1099s.

    State Laws and Regulations for Independent Contractors
    Workers can be considered employees under state law even if they are not considered employees under federal law, and several states have more strict definitions for ICs.


    Some states, including Florida, Iowa, and Michigan use the IRS common law test (or a variation) described above.


    Other states, including California, New Jersey, and Virginia, use a more restrictive worker classification test called an ABC test.


    The ABC test considers a worker to be an employee unless all of the three criteria are satisfied:


    A: The worker is free from control and direction of the hiring entity


    B: The worker performs work outside the entity’s usual course of business


    C: The worker is customarily engaged in an independent trade, occupation, or business of the same nature as the work performed for the hiring entity9

    As of October 2019, 33 states had implemented the ABC test or a slight variation of it. Check with your state’s labor department for information on its test for classifying workers.10
