I did some serious drinking and never had a hangover last past early afternoon the next day after I drank. I do agree that driving a truck while hungover is not a good idea.

Judge asked the cop , who’s property were you on ?
Cop did not answer. Why ?

I own my trk and trailer and I am subject to random drug screens as well.
Do as you please but if you need a drink that bad better rethink starting this career.
Lawyers will eat you alive. Remember .02 is the limit for a CDL holder. Any alcohol in a post accident you will be crucified. so ask yourself is it worth it?. -

When am I legally intoxicated?
You are legally intoxicated in Texas when your blood alcohol concentration reaches 0.08%, but you are breaking the law as soon as drugs or alcohol affect your driving — or flying or boating — ability.

Just like everywhere else, Texas is .08 in a personal vehicle and .04 in a CMV. A commercial license holder is not held to a different standard in their personal vehicle.

(b)(4)
(A) had an alcohol concentration of 0.04 or more, or that a controlled substance or drug was present in the person's body, while operating a commercial motor vehicle in a public place; or
(B) had an alcohol concentration of 0.08 or more while operating a motor vehicle, other than a commercial motor vehicle, in a public place.
Oh, and for the "no detectable alcohol allowed" crowd, last I checked the instrument's lower limit is .02. And yes, you're not allowed (nor should you), drive with any detectable alcohol in your system.Last edited: Mar 5, 2021

Last night when I was done with my driving I parked in the back of a grocery store parking lot and walked across the street to a steak house. Had 3 double whiskeys with my dinner and walked back to my truck and went to sleep. No problems to report.

Doesn’t the 0.04 rule apply even if you are at home at a bar on your week off?
