Tax Question: 1099 Oil Field Hot Shot

    I have a special case for my 2018 taxes and I sure as heck know I deserve per diem meals for 2018 80% of $63. Can anyone guide me on this?
    I was making 17 hour runs all the way from East TX, to West TX, and all the way back to East TX in one shift!!! Usually a Hot Shot driver has their own business but I was actually a 1099 employee who drove someone elses truck with a gas card. PickUp Truck/Cargo Van with a trailer shuttling oil field rotors which are always being rebuilt to guarantee drill operation sites.
    Round Trip:
    Distance: 984 miles
    Time: 14 1/2 hours drive distance (not counting Dallas Traffic, Gas stops, or breaks?)

    If you’re 1099 then you’re not an employee

    Independent contractor (employee would be W2)

    Can you claim the meal allowance when you return home every day?

    I know thats why I have doubt...the Oil Field People are super intense... Isnt it illegal to make a driver go 17 hours straight without a rest though?? Driving 1,000 miles should seem to qualify!

    I have no idea what you mean by per diem meals

    I had an llc and could write off a percentage of meals if they were actual business expenses, like taking a client out for lunch

    Have to be (I believe) 50 miles from home when you take your break to claim the meal allowance. Just traveling a long distance doesn't mean anything.

    Did You ever drive 1,000 miles in one run as a local driver?

    So as a 1099 I HAVE to search for deduction even though I didn't make much money :)

    Drivers who are spending long hours on the road away from home are allowed to deduct a “per diem” rate of $63 per day. The IRS understands that you’re spending a lot of time behind the wheel and food costs add up! For each day you are on the road, you are allowed to deduct $63 dollars from your annual income. If you plan to claim per diem rates, get to know the details. Local drivers are not allowed to deduct food costs because you are able to eat at home after your route is complete.

    The distance you choose to drive in a day doesn’t matter. You went home every night. So you weren’t working on the road.
