    Thank you for pointing this out to me! I think I got confused. Looking back the regulations were talking about 1.1, 1.2 and 1.3. Not 1, 2 and 3. From the link I provided in my last post, the first half of the regulations (I only quoted the 2nd half of the regulations in my last post):

    §397.5 Attendance and surveillance of motor vehicles.
    (a) Except as provided in paragraph (b) of this section, a motor vehicle which contains a Division 1.1, 1.2, or 1.3 (explosive) material must be attended at all times by its driver or a qualified representative of the motor carrier that operates it.

    (b) The rules in paragraph (a) of this section do not apply to a motor vehicle which contains Division 1.1, 1.2, or 1.3 material if all the following conditions exist—

    (1) The vehicle is located on the property of a motor carrier, on the property of a shipper or consignee of the explosives, in a safe haven, or, in the case of a vehicle containing 50 pounds or less of a Division 1.1, 1.2, or 1.3 material, on a construction or survey site; and

    (2) The lawful bailee of the explosives is aware of the nature of the explosives the vehicle contains and has been instructed in the procedures which must be followed in emergencies; and

    (3) The vehicle is within the bailee's unobstructed field of view or is located in a safe haven.

    (c) A motor vehicle which contains hazardous materials other than Division 1.1, 1.2, or 1.3, materials, and which is located on a public street or highway, or the shoulder of a public highway, must be attended by its driver. However, the vehicle need not be attended while its driver is performing duties which are incident and necessary to the driver's duties as the operator of the vehicle.

    So basically what you said is that I'll never haul 1.1, 1.2 or 1.3 materials as a solo driver with Estes (If I do indeed get on with them). Meaning that according to the regulations it'll be the same as driving a non-hazmat load when it comes to stopping and taking breaks at truck stops, rest areas and hotels. That's a big relief.

    Do you guys put on your 4 ways for stopping at the railroad tracks when your loads are hazmat? The regulations actually never specifically state to put on the 4 ways when stopping at railroad tracks for hazmat loads. But common sense would tell me to use them as the 4 wheelers probably aren't stopping at the railroad tracks every time unless the bars come down when the trains are passing by.

    The regs clearly state stop 15 to 50 feet within the railroad tracks, roll down the windows, listen for trains coming, go across the railroad tracks in the same gear with the windows still rolled down, then roll up the windows and change gears after you pass the tracks. But it never says anything about the 4 ways?

    I do, and on the shoulder or otherwise out of the through lanes if possible. Everybody I know does.

    Thank goodness you did. Estes can frustrate you at times, but they're a great company overall IMO. The pay is second to none!

    Yes and when you don't haul Haz loads all the time it is easy to have a brain fart and roll across one without stopping. FMCSA reg say minimum 60 day CDL suspension for first offense plus fine are outrageous,.

    3 weeks? Holy ####. That's a lot. I struggle being gone 11 hours. Being home is really nice.
