Forced to drive on a 5 ton road to get to scale for inspection.

    I will try and keep to facts only; 23 years driving never had this happen. But never drove a grain truck before either. I was on rt.52 in Manhatten Illinois officer took me to a scale in Joliet, off of S. Elwood Internation Port road.
    1. Pulled over by Manhattan "truck enforcement" officer. (no plate on trailer, totally my fault)
    2. After giving him a scale receipt from grain elevator, He said he thought I was overweight, and to follow him to scale. ok
    3. While following him for more than ten minutes; came to an intersection where it is clearly Posted a 5 Ton road. I mean clearly at least three large signs. I turned south on Rt. 53 and pulled over. Instead of continuing straight on w. Manhahattan rd. (This just infuriated the officer)
    4. He told me I have to follow him, he doesn't know another way to scale.
    5. Told him I need to talk to his supervisor.
    6. Officer threatened to arrest me, and tow and impound farmers truck and trailer.
    7. He called another officer, took my license, and said if I did not follow him that he would arrest me and impound truck. (never did see a supervisor)
    My real weight at drop off was 80,260lbs. gross
    Was this legal?

    As long as there are no rickity suspension bridges some really heavy dump trucks probably made that road. I wouldn't worry at all. Most weight regulations are there due to somebody screwing something up in the past, like losing brakes going down a hill, or even just NIMBY residents.

    Watch out around Elwood, I think you need an overweight permit to go through Elwood that's where a lot of the distribution centers are by the rail yards. You're lucky he didn't take you all the way to the one up on 80. Have you noticed most of the weight restriction signs are placed half a mile or a mile down the road ,you can't see them till after you make the turn.

    Hey MuddyDog79; Real question, Not a trying to piss ya off question. How and why is it legal for the officer to take me down that road? How does the officer have authority to have me disregard a weight limit road at his disgrestion? FYI. the reason I'm pissed with the officer is that He never said anything about going onto a posted 5 ton road, and snapped on me when I pulled over. My thought is what,... whatever the officer says to do I should do? Is that road posted only for 5 tons for a reason? There where 3 small bridges on that road. Glad you did a lol about just listening to the officer. I have 3.4 million certified safe miles out here, Not one accident. But back to the point is it ok to break one law and not another. My real weight remember was 80260 lbs. gross. So it was ok to delay me getting another load in for the farmer, go down a road posted at 5 tons, and not even get a ticket for the no plate on trailer. Sorry bud, maybe just ranting now... kinda pissed the officer feels I need to obey regardless of weight restriction road because" he did not know another way to get to the scale" that was the the reason he gave me. Be safe out there.

    Damage the bridge and it will be on you.
    I would ask the mayors office if they approve of this and if he ok’s it ask him to send you a letter stating the hold you harmless of you do it again and something happens.
    Or talk to OOIDA they love to straighten things like this out.

    Could be he is'nt from the area.I was stopped by a local in another small town, in the area, had 2 skids of alum. Tubing, wanted to go to a scale, I did'nt go. He was brought in from another little town to fill in

    I'm with you on that. I have a few police officers in my family. How are you going to be a good representative of the law & you don't (hypocrite). Then they have this complex I'm always right (you're not). I understand the sign is up there most of the time just to keep trucks off the road so the pavement doesn't get tore up & truck traffic through the neighborhood.
    They at times lose it when you question on principles and act like they can't be questioned. My friend just went through that during an inspection. I told him to fight it because the officer was wrong and shut him down on an eld issue.

    I'm glad you questioned him. Some if not all of them think they make the laws and have a little man complex.
    I've asked a few questions many times and those are, why does a cop get to speed for no reason? Why does he/she not have to use a hands free device when talking on the phone? Why can they type on their computer while passing me? Why they can have a gigh speed chase through a neighborhood in the middle of the day?
    The honor of protecting and serving has turned into control and conquer.

    I miss understood your question, i thought you were asking if your weight was legal, my bad. As far as the officer, you are pretty much at their mercy when it comes to that situation. Kill them with kindness is my motto, and it usually works.
