Yes...stupid question

    Couple of things.
    1. You can only use paper logs, which you must have at least 8 days worth, if the ELD is not functioning. Bad data is not enough to use paper.
    2. Simply get dispatch to edit the logs. If they can't there is something very, very wrong with the company.
    3. Ignore to violations on the ELD, they are false. You were off duty, and as soon as dispatch edits the logs to reflect this all will be good.

    P.S.
    You've been running illegal (Sure, just a minor requirement to carry paper logs, but the op is the one not wanting to move for minor violations) from day one. How is today any different?

    Anyone reading this make sure you carry paper logs. It’s a violation if you don’t. You’re supposed to be prepared.

    The company I’m leased onto, dispatch can in no way edit our logs. Once logs are certified, they can’t be edited period. (At least that’s what our “safety guy” tells me). Even before they’re certified, we’re told drive time can’t be edited.

    Drive time cannot be edited. It can be reassigned in a team driving operation, but that is all.

    If any other status cannot be edited, that's a company policy as the regulations state they have to be able to be edited.

    Spot on. But in my opinion this will need to be revised by the FMCSA. Their argument is that a driver should "NOT FORGET" to log off or should not "forget" to go into PC for example. But drivers DO sometimes forget to log out and the truck goes to a mechanic during the weekend and the mechanic blows up the driver's 34-reset. Sometimes an owner-op might forget to go into PC after dropping the trailer and heading home and they run out of hours. There used to be a provision for us to edit the drive time over to the mechanic. There used to be a provision to edit "drive" to "PC" on the current driver. But the latest revision of the rules says that you cannot reassign drive time any more EXCEPT to the "other" driver in a team situation only. Sure, people should be "perfect in a perfect world" and never forget or press the wrong button. But it's not a perfect world.

    That's why I always log out of the QUALCOMM as soon as I get parked on the yard. When I log back in, any unassigned drive time I can reject and indicate it was the mechanic.

    This is the smartest way. If you are walking away from the truck and there is any remote possibility that someone may move it, log off-duty and log out.
