Slip and fall in "off duty"status

    That's not necessarily true, according to the law, you have 30 days to inform your employer. Now, most companies require that you tell them in one day, and he might lose his job, but, if workman's comp claim, he's still on the right side of the law at 30 days.

    We tend to think that all states workers comp is the same, not. All states are different. In Michigan if your driving your 4 wheeler home and you get in a wreck within thirty minutes it's on your comp, not your auto insurance. Also if you are injured out of your home state your claim will be covered by your home state.

    I respectfully disagree with your statement. While a person is on Workman Comp he cannot be forced to take a position paying lower wages than his position when he got hurt, even when on "light duty" he has to be paid his normal wage.
    I got hurt on the job several years ago and since I am on Social Security and Medicare, the employer thought he did not have to pay me or pay the medical bills. Workman Comp insurance set him straight real fast. It is termed as "double dipping".

    I have never found a company who is in the "charity" business. 99% of companies have "ice water" running thru their veins instead of blood. Workers are only protected by an union or state laws.
    My former father in law was injured in a mining accident, spent the last ten years of his life in a wheel chair and I must say that through the union and Workman Coup he was taken care of, on the highest level. In most states, as in Virginia, through Workman Comp, a company is protected from being sued by an injured employee and this is where Workman Coup steps in.

    Not true in all states. I was on WC and I only received a percentage of my weekly pay. It will depend on the state. Also do not trust a WC doctor. They are not looking out for you only the insurance and company. Get a second opinion even if you have to pay fir it.

    I know where you are coming from. I went through this ordeal. First "quack" tried to pull a scam, I went for a 2nd opinion and exposed the scam that the first one was trying to pull.
