    I have my physical and drug screen tomorrow I last had one about 3 weeks ago and I have been actively loosing weight. I’m right on the edge of the BMI requirement now I was originally 323 but now I’m 310 if I have proof from last time that I have been loosing weight and all that can I get a exemption?

    What bmi requirement? Is that something that a company you are going to has set? The FMCSA does not have any BMI requirements as part of the DOT physical, as far as I know.

    FMCSA has a rule if you have a BMI over 40 you have to get a sleep study. If you are diagnosed with sleep apnea in that study you have to get a cpap and it’s a bunch more hoops to jump through.

    Incorrect Wyatt there is no bmi/sleep study requirements and never was. At one point there was guidance but even that has been taken off the books

    Nope. And Congress even passed a law that requires FMCSA to follow their own rules and do studies. Instead of following the law they simply "recommend" checking for apnea.

    No written fmcsa requirement BUT the approved examiners have a requirement by the fmcsa to check bmi and issue sleep studies to get cdl holders on cpaps.
    They got me on my naturally large german neck.
    I gave up my license over this after getting caught in the scam. Once they issue sleep study your license is held hostage until you buy cpap. Even if your general practitioner doctor says you dont need one. Good luck!

    You said it yourself. “Recommend”. The examiners “recommend” it by issuing 3 month certificates to drivers that have a certain neck measurement requirement for bmi. You will not get anymore than a 3 month cert until the “ recomended” sleep study is taken and you are on cpap for a certain amount of time.
    I know guys that just go every 3 months and get new cert. I wasn’t gonna waste the money and time for something that was “recomended” to me that I did not need. I had sleep study done a year before concentra “recomended” I needed another one. A had no problems but that report was not excepted because it was not done by a “recomended” sleep study lab involved in the racket.

    Then go to a dot dr that doesn't do that crap. It's not hard....

    There are lots of places in this world were you don’t have a lot of choices of other places to go. There is only one other option in the big city and some counties have none other than the chains that do it. When I went for a second opinion or try as you say. He even told me they have to “recommend” a certain percentage a year to continue to be certified. Some states have a little to do with it as well because some have their own standards beyond the fmcsa.

    You can do the excepted self certification in Texas to not need a med card but only if you were operating a cmv before august 28, 1989.
