Chocks should be a requirement everywhere.

Since 99% of drivers don't care about their brakes.

I don't disagree - but "my" plant buys $7 wheel chocks like they're going out of style. The loader is responsible for chocking the wheels, putting a jackstand in, and locking the glad hand. The loader must undo all of that before calling the yard jockey to pull the trailer. It's been 8 months since the plant has required chocks on both sides, yet the loaders still forget to clear the chocks on the passanger side. Yard jockey pulls the trailer without noticing it's there.

If you want to mandate wheel chocks, fine. Mandate ones that you can't run over.

It helps to know the Freight. A lot of my Loads are the same. I try to avoid the problem Shippers or Receivers. The low TONU rates make me suspect double brokering or so called cancelled loads, that were bid lower. I’ve had that happen. Broker uses Me, to insure the Loads covered, at a real good rate. Then obviously gets it moved much cheaper at the last minute. Bad Business. Sometimes Load gets covered twice. Sometimes it’s an honest mistake. I recently showed up to find a Mega that I used to work for 20 yrs ago, halfway loaded with my Load. Poor Driver said it was taking him home. I thought for sure the fix was in. Nope, I left with the Load. I felt bad for the Company Driver, but pretty good for myself. Bittersweet.

I don’t have a response to this that won’t come off real pointed/
If you’re running a service business, you’ll want to have safeguards in place to be paid for what you have provided.

Get it in writing before you point your truck in the direction of the pickup. This should be fairly standard when coming to a business agreement for transportation. who/what/where/when/how much, for what

Still doesn't mean you are guaranteed to get paid. But good enough, thanks for the response.

Well I'm going to add to the list today.

" Carrier must count freight at load/ unload. Carrier is responsible for any shortages damages late fees Etc."

    "Terms of the load:
-Accepting of the GPS tracking system
(they told me not to worry about any tracking)
    - if GPS not accepted load will be cancelled
    - after accepted and loaded if you turn off your phone you will receive a $250 fine.
    - if you are called by Dispatch for any reason, and you do not answer the phone, return the call, or text within 30 minutes, you will receive a $250 fine."

So if you are on the road and can't stop, if you are in a bad area at the shipper or receiver and have poor reception, you can Fork over $250.

If you are at a receiver worshiper and you obviously will not be allowed in the building you obviously cannot count The Frayed as it goes on and comes off, but if it somehow comes up short we're damaged dig in your pocket and you can pay for it.

And of course they only paid detention after three hours at a paltry $25 an hour.

So when I received the rate con I called and said I can't sign this. This tells me that I am completely 100% responsible if there's any short or damages on the load and I have no way of counting or verifying that. " Oh well you know that doesn't apply to this load that's for other types of loads that we do you don't have to worry about that".

So I said, well you do realize that if I sign that and there are shorts and damages that I'm saying that I am responsible for that. You can tell me that that doesn't matter but if I sign that I'm saying that I am liable for that and if it comes up short then I'm going to have a lot of trouble.

Then I said so if I can't get to my phone for 30 minutes or if I'm in a bad area you're going to fine me $250? "Oh well you know that's just because we've had carriers you know we can't get a hold of them so I mean if we can't get a hold of you you know like for a couple of days then we would fine you".

So I said, that doesn't say a couple of days that says 30 minutes. You realize if I sign that and for some reason you can't get ahold of me for 30 minutes I'm agreeing that you can take $250 out of my settlement. " Oh well you know we would never do anything like that and we've been in business a long time and we wouldn't do that if we did that kind of a thing we would never have lasted this long and really it doesn't mean anything it's just on there. It sounds to me like you're looking for reasons to not take this load.

So I said, actually I'll be happy to do the load. Just take the $250 fine off the rate con for not answering the phone for half an hour and take off of there that I'm responsible for any shortages and damages because I can't possibly count it and I'll be happy to do the load.

"Oh no, we can't do that."

Okay, have a nice day. Click.

They always make it look like such one sided scam, don't they? How many new agreements have you seen without some of this crap...1 out of 20?

This is the part of the reason why I only have used big brokers for the last 3 years. Still, I am not sure 100%, what hooks they got on me there too. lol
I guess, your trying to negotiate the contract is the only proper way. Every time one has to read it and make to the point that it is safe to commit to a load.
It is not always easy, being stressed for time and from within the sleeper of you truck, to study these terms and conditions. I bet most "independents" don't give a ####, just sign it tempted by the rate.

Anymore I do a lot of work with the same brokers. When I see a new broker on the load board even with good credit rating and all of that, it's stressful because you have to fill out the packet and do the whole thing and then all the sudden you see crazy stuff on the rake on and you have to start over again.

It is always in their favor and anyone is kidding themselves if they think it's not. But it's just the flat-out hey I'm going to screw you right in front of your own eyes that's the kind of stuff that I just can't take. $250 if you can't get to your phone within one half of an hour. Things like this are excessive and arbitrary and completely unnecessary and overwhelmingly belligerent toward the carrier. No one should ever work for a broker like that I don't care what rate they give you.

    100%.

There are some idiots somewhere that are working for them. It's hard to believe but it's true.

I had a choice of two loads today after all that Fiasco. I could pick one load with an unknown broker that I have not seen their agreement or their rate con for a significant amount of money, or I could take a known broker that is paying okay for what it is but I would certainly have made more with the other broker.

Hands down I chose the broker that I would make less money with because I know they're a good broker.
