It helps to know the Freight. A lot of my Loads are the same. I try to avoid the problem Shippers or Receivers. The low TONU rates make me suspect double brokering or so called cancelled loads, that were bid lower. I’ve had that happen. Broker uses Me, to insure the Loads covered, at a real good rate. Then obviously gets it moved much cheaper at the last minute. Bad Business. Sometimes Load gets covered twice. Sometimes it’s an honest mistake. I recently showed up to find a Mega that I used to work for 20 yrs ago, halfway loaded with my Load. Poor Driver said it was taking him home. I thought for sure the fix was in. Nope, I left with the Load. I felt bad for the Company Driver, but pretty good for myself. Bittersweet.

If you’re running a service business, you’ll want to have safeguards in place to be paid for what you have provided.
Get it in writing before you point your truck in the direction of the pickup. This should be fairly standard when coming to a business agreement for transportation. who/what/where/when/how much, for what -

- after accepted and loaded if you turn off your phone you will receive a $250 fine.
- if you are called by Dispatch for any reason, and you do not answer the phone, return the call, or text within 30 minutes, you will receive a $250 fine."
So if you are on the road and can't stop, if you are in a bad area at the shipper or receiver and have poor reception, you can Fork over $250.
If you are at a receiver worshiper and you obviously will not be allowed in the building you obviously cannot count The Frayed as it goes on and comes off, but if it somehow comes up short we're damaged dig in your pocket and you can pay for it.
And of course they only paid detention after three hours at a paltry $25 an hour.
So when I received the rate con I called and said I can't sign this. This tells me that I am completely 100% responsible if there's any short or damages on the load and I have no way of counting or verifying that. " Oh well you know that doesn't apply to this load that's for other types of loads that we do you don't have to worry about that".
So I said, well you do realize that if I sign that and there are shorts and damages that I'm saying that I am responsible for that. You can tell me that that doesn't matter but if I sign that I'm saying that I am liable for that and if it comes up short then I'm going to have a lot of trouble.
Then I said so if I can't get to my phone for 30 minutes or if I'm in a bad area you're going to fine me $250? "Oh well you know that's just because we've had carriers you know we can't get a hold of them so I mean if we can't get a hold of you you know like for a couple of days then we would fine you".
So I said, that doesn't say a couple of days that says 30 minutes. You realize if I sign that and for some reason you can't get ahold of me for 30 minutes I'm agreeing that you can take $250 out of my settlement. " Oh well you know we would never do anything like that and we've been in business a long time and we wouldn't do that if we did that kind of a thing we would never have lasted this long and really it doesn't mean anything it's just on there. It sounds to me like you're looking for reasons to not take this load.
So I said, actually I'll be happy to do the load. Just take the $250 fine off the rate con for not answering the phone for half an hour and take off of there that I'm responsible for any shortages and damages because I can't possibly count it and I'll be happy to do the load.
"Oh no, we can't do that."

This is the part of the reason why I only have used big brokers for the last 3 years. Still, I am not sure 100%, what hooks they got on me there too. lol
I guess, your trying to negotiate the contract is the only proper way. Every time one has to read it and make to the point that it is safe to commit to a load.
It is not always easy, being stressed for time and from within the sleeper of you truck, to study these terms and conditions. I bet most "independents" don't give a ####, just sign it tempted by the rate.gentleroger Thanks this. -

I had a choice of two loads today after all that Fiasco. I could pick one load with an unknown broker that I have not seen their agreement or their rate con for a significant amount of money, or I could take a known broker that is paying okay for what it is but I would certainly have made more with the other broker.
Hands down I chose the broker that I would make less money with because I know they're a good broker. -
