Hello, wondering if anyone in here has dealt with a situation like this. A driver is suspected of doing point to point shipments within the US by the CBP. It's in his file and he was told he has to prove he did not do the work in order to be aloud to cross. Is there a process to this? Has anyone gone through this before?

I know of a few guys that lost FAST cards over being accused of doing point to point when they crossed at Detroit. Not sure about your driver's situation, he'll probably be flagged in the system when he crosses and will probably have to see immigration when he crosses.

Its difficult to prove you didnt do something you were accused/suspected of but never brought to court....happens lots in the financial industry. Proper authority can issue a letter but that’s a hurdle and means they sticking their neck out for a “suspect”

So, did you, err your friend, actually run a point to point run in the U.S.?
If not logs should be helpful here. Paper logs and supporting documents like receipts will help. Unedited ELD logs will be better if you have them.Wasted Thyme Thanks this. -
Haha thanks for the helpful responses here, some of them at least. And no, this driver was not me, just trying to help. He's trying to compile some sort of case for himself, the only trouble is that there isn't a process or system to do it. I'm guessing he basically has to try to cross again with the evidence and hope someone believes it? Just seems like a piecemeal way of running your border.

I was at Concord Transportation, did a run Toronto to NewJersey. Then they wanted me to do a rounder to North Carolina. Then back to Toronto.
I said not a chance. They said it’s a grey area. I said get your own company trucks to do it, not an owner operator’s. They knew it was a problem, if my truck got impounded, wasn’t their problem.
I still refused, they got mad, I held my ground. When I got back to Toronto they admitted I was right.Last edited: May 4, 2021
