I want to hire someone

    I am an LLC with my own authority, trying to bring on my brother in law. I am curious what would be the best way to pay him 1099 vs W2. I am going to have him riding in my truck with me. This is my first employee ive ever had and id really appreciate some guidance.

    If he's an employee then a W2 is the only legal way to pay.

    Looks like you’re right according to what I’ve been reading. Have you hired employees before? I am signing up with the Wyoming unemployment/workmans comp but he is a New Mexico resident and will be paying taxes in that state, does that mean I need to file in New Mexico too?

    Employees, yes but in construction and not trucking not that that makes any difference but I've never dealt with duel states before. Should be an easy question for your CPA though.

    One option would be run him through a temp service. I did that often in construction. You pay them a few points and they handle everything including comp, tax deductions and any safety stuff they may want to put him through .
    They pay him and you pay them.

    I deal with a CPA, I text her the first Monday of every month what was paid (keep in notes on phone and written in a yearly journal that I keep all load info in) and she does the payroll taxes and that gets sent in by her, on my behalf on the 15 of every month.
    $850/year and I don’t have to do anything but go sign a quarterly report every quarter.
