Force to move truck during 10 hour break because of emergency

    Was on my 10 hour break then being asked by emergency personnel to move. Literally took 3 mins. Which of course reset my 10 consecutive hour break for a 14 hour restart. Do I have to restart the clock or can I pick up from where I left off? I am new to this and need help.

    I’d just make a note on the logs and not worry about it

    Hopefully someone else will chime in with a more knowledgeable answer
    This is one of the many fuzzy grey areas

    isn’t there a way to move the truck slowly without triggering the ELD ?

    In the old paper log days, I would have just ignored the interruption, with today's electronic tracking I would call my carrier's log/safety dept and ask them directly. Your question has piqued my curiosity a bit! Where were you taking that 10 at that caused you to be in the way of emergency personnel?

    There is a provision for moving during a rest break as directed by law enforcement, emergency personnel should be the same.
    Just put in remarks and let safety know.
    If you refused to move for emergency personnel, they would have gotten the police to get you to move anyway, and you can not refuse their order to move.

    I'm going to amend my comment a bit. I never used ELDs. I retired in 2012. If you can try to keep said communication ON THE QC. This protects you if there is an issue later on. This advice about the QC means ALL contact with the carrier that has anything to do with the truck and load!

    Move the truck, note it on the log and send a note to your safety people telling them what happened and being instructed to move the truck. They should note it on their end and everything will go on as nothing happened.

    I would have moved on PC and noted the reason in the comments. No need to restart your 10.

    Most company drivers don't have PC. But I believe the safety dept can amend the comment once that day's log is certified.

    We have that happen on a regular basis.
    Some good samaritan sees a trailer venting and calls 911.
    Fire department is obligated to respond and contacts motel and they call up to the room.
    Go down and explain to fire chief that venting is normal etc. Now my 10 has been interrupted.
    afaik there is no provision allowing this.
    My bosses kinda wash their hands and say "do what you think is right."
    Probably would only be an issue should you be involved in any type of incident where your past day is investigated, say like a fatal, and they find your rest was interrupted, and could be used in a criminal trial or civil suit.
    I've gone both ways..started my 10 over and let it slide. Mostly depends on how far in I am.

    If you have PC available just use that, noting the reason for the move and it won't cause you to have to restart your clock. Otherwise just note on your log the reason for the move and go anyway when your original break is up. Your ELD will be yelling at you all day that you have a violation but nothing you can really do about that. Any LEO should be understanding if it if you are inspected so long as you note it.
