    i dunno...it's 6 of one, half a dozen of another..

    the insurance company can question why he was ejected....

    no seat belt...????

    hard to really know how the jury will see it, but a good defense lawyer can play up the fact of his ejection, had he be belted in...

    then too, a log truck, what's even deadlier..??

    being belted in, and having those logs kill you when they go thru the cab..????

    How do you figure he would noticed the steering wheel during a pretrip? The nut is under the horn, there is not a driver on this earth that checks that nut for tightness during a pretrip. Even with the nut missing the wheel would have still held tight like the nut was on tight. This is why you use a puller to remove a steering wheel.
