    PERMANENT DISQUALIFYING CRIMINAL OFFENSES

    An applicant will be disqualified if he or she was convicted, pled guilty (including ‘no contest’), or found not guilty by reason of insanity for any of the following felonies regardless of when they occurred:

    • Espionage or conspiracy to commit espionage.
    • Sedition or conspiracy to commit sedition.
    • Treason or conspiracy to commit treason.
    • A federal crime of terrorism as defined in 18 U.S.C. 2332b(g), or comparable State law, or conspiracy to commit such crime.
    • A crime involving a TSI (transportation security incident). Note: A transportation security incident is a security incident resulting in a significant loss of life, environmental damage, transportation system disruption, or economic disruption in a particular area, as defined in 46 U.S.C. 70101. The term “economic disruption” does not include a work stoppage or other employee-related action not related to terrorism and resulting from an employer-employee dispute.
    • Improper transportation of a hazardous material under 49 U.S.C. 5124 or a comparable state law.
    • Unlawful possession, use, sale, distribution, manufacture, purchase, receipt, transfer, shipping, transporting, import, export, storage of, or dealing in an explosive or explosive device. An explosive or explosive device includes an explosive or explosive material as defined in 18 U.S.C. 232(5), 841(c) through 841(f), and 844(j); and a destructive device, as defined in 18 U.S.C. 921(a)(4) and 26 U.S.C. 5845(f).
    • Murder.
    • Threat or maliciously conveying false information knowing the same to be false, concerning the deliverance, placement, or detonation of an explosive or other lethal device in or against a place of public use, a state or government facility, a public transportations system, or an infrastructure facility.
    • Violations of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. 1961, et seq., or a comparable State law, where one of the predicate acts found by a jury or admitted by the defendant, consists of one of the permanently disqualifying crimes.
    • Attempt to commit the crimes in items (1)-(4) of this section.
    • Conspiracy or attempt to commit the crimes in items (5)-(10) of this section.
    PART B
    INTERIM DISQUALIFYING CRIMINAL OFFENSES

    Conviction for one of the following felonies is disqualifying if the applicant was convicted, pled guilty (including ‘no contest’), or found not guilty by reason of insanity within seven years of the date of the application; OR if the applicant was released from incarceration after conviction within five years of the date of the application.

    • Unlawful possession, use, sale, manufacture, purchase, distribution, receipt, transfer, shipping, transporting, delivery, import, export of, or dealing in a firearm or other weapon. A firearm or other weapon includes, but is not limited to, firearms as defined in 18 U.S.C. 921(a)(3) or 26 U.S.C. 5 845(a), or items contained on the U.S. Munitions Import List at 27 CFR 447.21.
    • Extortion.
    • Dishonesty, fraud, or misrepresentation, including identity fraud and money laundering, where the money laundering is related to a crime listed in Parts A or B (except welfare fraud and passing bad checks).
    • Bribery.
    • Smuggling.
    • Immigration violations.
    • Distribution, possession w/ intent to distribute, or importation of a controlled substance.
    • Arson.
    • Kidnapping or hostage taking.
    • Rape or aggravated sexual abuse.
    • Assault with intent to kill.
    • Robbery.
    • Fraudulent entry into a seaport as described in 18 U.S.C. 1036, or a comparable State law.
    • Violations of the Racketeer Influenced and Corrupt Organizations Act under 18 U.S.C. 1961, et seq., or a comparable state law, other than any permanently disqualifying offenses.
    • Voluntary manslaughter.
    • Conspiracy or attempt to commit crimes in this section.

    Another great post because you just taught me something I didn't know. I thought I was out of there on Hazmat. This may be my option in the future! I left off the part that my family in West Texas is actually in the Oil Wholesale business and has an entire fleet of trucks. As of right now though, I have my mind set that going OTR for 6 months to a year is not going to be a bad thing. It will allow me to put some long miles in and get some good experience on the road.

    Again, I appreciate all you guys taking the time to help and I look forward to chatting with you guys over the years to come. As far as falling back in my old ways, that's long gone. I have a sweet little daughter and a wife to take care of now and that's my priority.

    I went through the entire list and don't have any charges that would disqualify me unless I missed one. But reading through it, I seen nothing disqualifying for me so that's good news!

    Well, that's a pretty fair list. Of course to sum it up, if one's felony had any violence involved, they're pretty much out of the HAZMAT running. I feel for those guys that were straight laced up to a point and then after blowing up just one time, they're now in destitute/recidivism land.

    What's the name of the company? Thousands of trucking companies in CA, so doesn't help the forum much to simply say a company in CA.

    There are several companies that will take you, don’t let others or even company websites say otherwise. I also have a felony aggravated assault charge, and I’ve never let that stop me. All I would do is apply to any and all companies that I was interested in, and I was honest with my situation. As a result, I had quite a few offers. Some said no, but that’s to be expected. I would just thank them for their time and move on. I think a lot of it has to do with how you carry yourself. If I had to describe myself in 100,000 words, convicted felon would not be in those words.
    I have worked for a few good companies, now I’ve got several years under my belt and am hauling hazmat tank. A lot of my success I believe is because I didn’t give up, and I refused to take no for an answer. Good luck!

    Lots of misinformation out there about felons and opportunities in trucking. I read in comment somewhere else on the internet that felons can't get a CDL. I think some put that garbage out there because they don't want convicted felons being able to drive a truck.

    Probably so, unfortunately. I never expected to have a felony record. I grew up in a stable home, served 8 years in the Army, had good jobs, etc.
    But it’s amazing how quick things can happen. What started off as an innocent night of drinking with friends ended with me getting taken at gunpoint by the State Police. I’m not proud of it, but I don’t regret it, either, it led me to where I am today and I wouldn’t change a thing.

    I'm sorry but I can't cause an unneeded #### storm in there office by posting the name for all to see i was just trying to let people know that a felony does not stop you from getting a job in trucking.These companies are not big about 15 drivers each.
    I did check with them today and they have an opening for 1 driver running a truck and transfer hauling sand and gravel in San Diego, but they require experience I also know of anther company in San Diego that is always looking for dump truck drivers and i have seen them hire people with very little experience and a felony is no problem the equipment is pretty new and good looking but drivers don't seem to stay more than a few years so while i won't post up there names you can PM me and i will share the names, while my name on hear does not mean anything to anybody locally a pic of any of my trucks trucks identifies me dam fast.
