state tax question

    Company based in illinois, im in illinois but they want me to fill out an Indiana state tax form. Which probably be ok in the long run probably cheaper then illinois. My question is do I still have to pay illinois tax? This has always confused me

    I don’t know why the company would want to use Indiana as your residence, if you don’t live there? What would you use as your residence address?

    Generally you only pay taxes to the state in which you reside. It's called the Amtrak Act and applies to Nonresident employees of motor, rail, air and water carriers. There are a few caveats I believe one being if you, in your case, live in IL but work exclusively in IN you may have to pay IN state income tax. However if your "regularly assigned duties" are in more than one state, then you pay state income taxes where you reside. BUT, I'm not a professional and as all laws certainly are not worded for the common lay person, it is always best to ask a professional that deals with taxes.

    "Regularly assigned duties in more than one state" means duties that are performed on a regular basis in more than one state, e.g., daily, weekly, or monthly assignment. Duties that are performed on an "on-call" or "as-needed" basis, or duties that are performed on a sporadic or intermittent basis during the year, are not considered to be "regularly assigned duties."

    Any company position I have held has been with companies out of my state of residence (that does not have state income tax) and I have never paid state income taxes based on where the company is domiciled.
