Since I finally had a broker put no detention paid on the load on the rate con I have come up with my own terms to send to a broker that I do not know.
Has anyone else done this with success?
Has anyone sent terms to one of the mega brokers?
Who sends detention terms and conditions prior to a load?

Here is what I came up with
The following terms and conditions override any that are printed on the rate confirmation. Broker shall reply "Agree to supplement of rates from carrier" in an email or text.
1. Detention is paid after 1 hour at a rate of $100 an hour.
2. Layover is paid on any detention over 5 hours at a rate of $500 plus 5 hours detention at $100 an hour
3. Refused loads are $100 an hour plus $10 a mile to a new facility
4. No claims shall be made on loads signed SLC with a closed shipping dock that are not fault of equipment.
5. No late fee will be paid to broker.
6. No fees will be paid to broker for missed check calls, or tracking issues, (driver is available by phone during business hours for updates)

I doubt they're going to sign off on your terms and conditions.
A friend tried the tactic of 'crossing out' a few of the brokers terms, and they wouldn't sign, and found another truck.

Honestly there are a lot of people that say a lot of things and maybe that's just the internet.
But in this business you're just a truck. You may be on time and dependable and have a good safety rating but you're just a truck. Just like someone else is just a truck. You may find a broker somewhere that will agree to that but 99.99% of Brokers are just going to tell you what their terms are and that's it you take it or leave it because it's too easy for them to just find someone else. There's nothing that unique or special about you.
Now maybe if you had 10 or 15 trucks and you could move a lot of their freight then maybe you could start to dictate more terms. But one guy with one truck or one guy with two or three trucks is just a guy with a truck.
And just quickly I get a lot of detention sometimes. I've always been payed it. To me, if the load pays well, detention is just something extra that's all.

I recall booking a load that was $4000 over the rate for the lane. 30 min later they apparently had another load from the same place, got desperate, and upped the rate an extra $3000 to find the last truck. Went for 9500 to that driver for a 900 mile load. Blow off enough drivers, find yourself in trouble.

I do it on every load I pull. I have an entire Policy that needs to be agreed to in writing. If they don't agree, it's because they aren't direct with the customer, their customer is cheap or it's going to be a problem load and the broker knows it.
However, you must be willing and able to sit and wait for a load that works. Most aren't willing to sit. In the long run, you'll probably make more without the policy but I just can't run like that.
Know YOUR position in the negotiation process. If they need that load moved you'll get whatever you want. If they're just calling around trying to find a cheap stupid truck then they'll pass on you. They're the same suckers that come here bad mouthing the broker when it was themselves that agreed to it in the first place.
It's pretty sad how few actually read the things they sign and give away so many services for free. They're literally bleeding revenue.
I don't haul for TMC nor Anderson Truck Service because they have clauses in their Agreement that states I don't get paid if their customer doesn't pay them.
Neither would remove that clause so I don't haul for them and I love telling them all about it when they call me for a move.Speed_Drums, TheLoadOut and clausland Thank this. -
