1099 is not a legal pay structure for employees. You are not a contractor since you do not own the tools of the trade (the truck). Very simple.

If a 1099 driver makes enough to offset self employment tax and no benefits, it really isn't all that bad. I hate being a company slave where they tell me they will kindly grant me one whole week off after one year.
No, without a 401k, without medical insurance, there isn't a whole lot to keep me from cleaning out my trick and doing something else for a month, or six months, or however long I want. Then, I tell the truck owner, 'hey, when you get an opening, I'd like to come back (or, just go someplace else)
This isn't rocket surgery. I'm not messing up a whole team with my coming and going. The employer invests very little in training me (I did that long ago). Give me the keys, OK, here we go.
Nah man, it feels good to feel like my life belongs to me. 'We hire you to retire you?' Heck with that! I have other interests. When I really need the money...got that trusty old CDL.
Self employment tax, medical, 401k? That's a huge loss and the 1099 driver needs to take all that into consideration.
The legality of it all? I need to look into that more. Lots of drivers on 1099 and no one seems to be hiding anything. IDK!? -
