I don't think I can but the boss says I could.
Situation.
I'm 230 miles from my pickup of sacks of potatoes. I'm not sure but I think it's too far.
I haven't ever used ag exempt before.
Anyone have a good website that clearly explains the rules?

- 49 CFR § 395.1(k) provides exceptions from the HOS rules, during planting and harvesting periods as determined by the State, for the transportation of agricultural commodities (including livestock, bees, horses, fish used for food, and other commodities that meet the definition of “agricultural commodity” under § 395.2) within a 150 air-mile radius from the source of the commodities. The exception also applies to the transport of farm supplies for agricultural purposes shipped from either a wholesale or retail distribution point to the location the supplies will be used or from a wholesale distribution point to a retailer

You can go 80 miles driving, then off duty (or PC with an ag note) for the rest of the 150 miles. Now that's an air mile radius, so actually a little more.

So I start my day on the regular clock then once I'm 150 miles from my pickup I can go on Personal Conveyance under ag exempt, do the pickup, then go back to regular clock before going more than 150 miles from the pickup.
This would definitely help save some of my hours. -
PC is for PC only. It can’t be used to accomplish your work.

Commodity has to be in harvest or planting. Storage out of season does not count. Refer to state in question USDA office or online for seasons.

The radius is 172 miles, AS THE CROW FLIES, and is for both coming and going. So if you’re 180 road miles out, yes, you most likely can go ag exempt at your current location.
