    A guy I grew up with got charged similarly. He was asleep on the seat of a wagon with one of his light teams heading for the barn with it after a parade in town. All went away in court eventually but it was a headache he didn’t need. That team logged by themselves. He’d hitch them up in the bush and send them down to his dad on the landing. He’d unhitch the logs, lay the whipple-trees and rigging up on their backs to they wouldn’t get tangled up on the way and sent them back up. Same haying, he’d load the wagon in the field and send them down to the barn for his wife to unload. He had 2 light teams and a heavy team that he and his father did a lot of custom logging/thinning with as well as a lot of the work on his own small farm. Amazed me how much they worked on their own.

    He was legal here. .08 is where the cuffs come out. Well, if you’re conscious I guess. Our laws are weird, we have 2 different charges for the same thing. Impaired driving, and driving over .08. The penalties for both are near identical. They need a breath sample to prove over .08, but they can get a conviction for impaired driving without a breath sample. If they’d used impaired driving on the cellphones they would have charged 3 people and that would have been the end of it. More political mileage in a new law to save people with I guess. Even if it doesn’t work.

    The person operating the horse and buggy was identified as Nathan Miller, who took a breathalyzer test and registered a .063%, according to police.

    Miller was arrested and charged with operating a vehicle while under the influence.

    Police initially responded to 911 calls from people who claimed the buggy was "all over the road."

    personally, they gave the breathalyzer to the wrong driver......

    it was the dang horse that was all over the road...!!!!
