Just got hit on I-80 toll road in Ohio, car spun out and hit me.

Someone is sure to come along and post "it will buff out". Well, bent rims don't buff out. They just don't. Sorry.

 

Was the other person hurt? They might try to blame it on you and sue. Every other billboard is a personal accident attorney with a picture of a big rig behind him.

Was there highway camera to back up your story?

Try to get a copy of the police report. It should have the statements you made to the officer on it and they can be used against you in a lawsuit.

Hard advice to follow in a stressful situation, but it's best to say little to nothing. Don't screw yourself with your own words:

"It happened so fast I didn't have time to react."
Why? Was it because you were going too fast for the conditions?

"Hell, I didn't even see them in the mirror so I assume they were in the far left hammer lane."
Translation: I wasn't checking my mirrors and paying close attention to my surroundings .

Hope nothing comes from it. Similar thing happened to me in the NE a few years ago. Flattened a tire on my trailer, no injuries but lady's car towed with minor damage. State police showed up, made a report. Nothing ever showed
up on my driving record about it. Nothing. Sometimes we catch a break.

 

Hopefully you kept your mouth shut and only stated facts to the cops. Looks like only the rim and tire need replacing. I’d probably check on the alignment maybe suspensions too. The 4 wheeler might hire an ambulance chaser and make your company’s business a living hell for abit until either they settle or the lawyer finally burns out. I wouldn’t stress too much about it honestly what’s done is done. If your trucks have dash cams and shows what you said here I’m pretty sure not much will happen. If the ambulance chaser representing the 4 wheeler decides to call you don’t talk to him. Politely tell him if he has any questions he can call your company.

 

That is a DOT recordable accident. One of the pre-cursors for that is if one of the vehicles involved in an accident is towed away from the scene. Since you used the word "totaled:" in describing the car, I assume it didnt drive away from the scene. I dont know your employers rules but, per DOT rules, you are not required to take a DOT drug test.
However, CSA points are attached(I think its 3) to the company.

 

As stated above, you're not required by the FMCSA to take a drug nor alcohol test. I'm betting your employer will force you to take one for the company though. Also, don't worry about your personal insurance going up. You got no tickets to be on your record and any insurance claims are on your employer so nothing will be on your CLU either.

I had a guy lose control of his car while passing me on the left
He spun out. Hit the side of my trailer. Flew back over the berm divider in the center of the hwy and ended up on the shoulder of oncoming traffic

Cops showed up and it was clearly his fault
His insurance paid for my minor repairs and that was all that ever became of it

 

Probably won’t ever hear anything about it. No ticket. Get a copy of the accident report, for your records. Get it interpreted if needed. Look for any vague check marks, codes or abbreviations. You have nothing to worry about. Probably cheaper to buy a rim, have it installed, instead of paying deductible. Insurance premiums won’t be affected.

 

That’s true. Forgot about that. Any vehicle towed, or anyone taken by ambulance makes it recordable.

 

Good reference chart. The same thing pretty much happened to my dad last month. Car run into the drives coming on the highway. No citation issued no test.
