It really benefits us drivers who hustle at a smaller carrier when we look so much better for just doing what we're supposed to.

Your best bet are for the DOT and FMCSA to step in and use their everlasting powers of micromanagement to force changes in the way drivers are paid and classified.

Most of you all, and unless you work for a mega carrier that has a team of lawyers on staff, your trucking company as well does not understand some of the very draconian labor laws that are in place. And they are there for your disposal. Many of them tied into OSHA. Most of these laws come with a per incident significant penalty that goes to you, “the victim“. I can almost guarantee you on a daily basis the average mid sized to small trucking company violates countless labor laws that they could be held liable for. No I’m not one to go out pursuing these things, that’s just not my cup of tea. I like to be low-key, keep my mouth shut and do my job. Yes I’ll stand up for myself if need be. But I do it internally. These companies have no idea how much potential loss they’re subjecting themselves to. Even just calling you when you’re off the clock can get you a six figure settlement. Someone talking about screwing their wife last night in front of you can get you a sexual-harassment settlement to the tune of $10,000 per incident. Having you run and pick up one trailer and swap it out for another 10 miles across town without paying you for it can you do $50,000 per incident. Look this stuff up.
If you send maintenance a message there’s something wrong with the trailer brakes and they ask you to “limp back to the yard“. That can get you another $50,000.
i’ve owned my own business, and I watched my father struggle owning his own businesses throughout his life so I’m not one to be Sue happy. But it does amaze me how willingly and naïvely these companies just stick their necks out.snowman1980 and Gearjammin' Penguin Thank this. -
