Not knowing, but I have always been under the impression that it was a law, once the shoulder is used for an emergency, you have two hours to take care of the emergency, then the vehicle is subject to be towed. From Staunton, Va 1-81 to 1-40 in Tennessee Both states, Va, Tn and a towing company could make a fortune enforcing this

in other words, would have died anyways. even IF the dead driver had a medical issue himself, he would have still crashed.
i'm going with...4:30 AM, a micro sleep, speeding, and the accident.
at most, what will the parked driver get?
1) maybe a ticket
2) an accident on his record, but at fault...or...not...?? don't forget, he wasn't driving, he was parked, it was the other driver that FAILED to negotiate that curve.Boondock, Another Canadian driver and Hulld Thank this. -

In my opinion the thread should be titled “stop running off the road and killing your self”
If it wasn’t a truck parked out of the driving lane he hit it could have been a tree, a guard rail or maybe a bridge abutment?
Or how about a pedestrian walking on the shoulder would it be his fault if someone left the driving lane and ran off the shoulder and hit him?
