Stop Parking on Shoulder!

    Not knowing, but I have always been under the impression that it was a law, once the shoulder is used for an emergency, you have two hours to take care of the emergency, then the vehicle is subject to be towed. From Staunton, Va 1-81 to 1-40 in Tennessee Both states, Va, Tn and a towing company could make a fortune enforcing this

    thing is, there really isn't a AAA for broke down trucks. every time i was ever broke done, up to 4 hours just waiting for a service truck was the norm.

    unless each state posts ..
    "no parking anytime"

    or

    "tow away zone"

    or

    "emergency parking only" signs,

    truckers will park on the shoulder.

    i don't support it myself, but, hey, no signs? well then no complaints.

    In this case,Pennsylvania has them posted. It’s just that some drivers either knock them down or just DGAF! And like Virginia they’re getting sick and tired of cleaning up wrecks involving trucks illegally parked on the shoulder as well. Article clearly stated the truck on the shoulder was parked illegally. Last time something like this happened in Virginia as well as the driver who fell asleep behind the wheel causing the accident the driver(s) who illegally parked on the shoulder got cited as well! A few companies (my employer included-they consider it grounds for termination)have policies about this as well.

    $100 to $1, you will get a ticket parked on an Interstate in Virginia, sign or no sign. Plus the ramps are considered part of the Interstate .

    Yup. Stevens has a "sitting duck" policy. Have to call safety and get permission.

    if the stupid driver, that could not negotiate a curve, at 4:30 AM (as in the article), was speeding and i think he was, he would have gone off the side of the road, and down the hill, cliff, ditch, whatever.

    in other words, would have died anyways. even IF the dead driver had a medical issue himself, he would have still crashed.

    i'm going with...4:30 AM, a micro sleep, speeding, and the accident.

    at most, what will the parked driver get?

    1) maybe a ticket

    2) an accident on his record, but at fault...or...not...?? don't forget, he wasn't driving, he was parked, it was the other driver that FAILED to negotiate that curve.

    There have been multiple incidents of drivers ILLEGALLY parked on the shoulder going to jail and/or being sued. You have no idea why the driver failed to make the curve, thing is he's dead. May not be if the parked truck wasn't there. One thing I know for sure is that if the parked truck had been somewhere legal they wouldn't have been involved. Only reason to be on the shoulder is medical or mechanical issues. I've limped miles to avoid staying on the shoulder. Never stop because ran out of hours. I'll let you in on a secret, the eld doesn't shutdown your truck. I'd rather get a ticket for running over hours than deal with a possible fatal accident.

    In my opinion the thread should be titled “stop running off the road and killing your self”
    If it wasn’t a truck parked out of the driving lane he hit it could have been a tree, a guard rail or maybe a bridge abutment?
    Or how about a pedestrian walking on the shoulder would it be his fault if someone left the driving lane and ran off the shoulder and hit him?
    Responsibility needs to be placed on the entity that committed the act of running off the road not on objects that are stationary.

    Stop driving on the shoulder and you won't hit anything parked there.
