Who is going to have a low pay increase when the company goes looking for where to cut corners from thier budget?
That guy just reached into your pocket and stole half of next years raise from you! I would say it’s about the same as ripping a hole in the fender of your car! He ain’t your friend, he ain’t your buddy, he isn’t a teammate, he is your adversary and a thief! Call and tell them you have it on your dash cam and will get it to them. When the cops show give your statement.
Having someplace to go and not making it might be an issue but I ask, what if you had a break down on your way, what if you got tied up in a huge traffic jam? We are truck drivers and know these risks of not getting there when we would like exist deal with it or quit driving truck because eventually it’s going to happen one way or the other!
By the way do you realize he might just be hoping to blame you for the damage.

Well the problem there is clear...people driving on the wrong side of the roadbryan21384 Thanks this. -
OK hit my truck, Just wipe out a mirror it isn't going to be the price of the mirror and labor to replace it that's going to cost you and your insurance company more because I won't deal with making a claim with mine, I have a lawyer to recoup the costs directly.
It is going to be the mirror, the labor, the cost of moving that truck from its location to the dealer, the downtime for that truck and driver in the form of lost revenue. The last moron who "rubbed" against one of my trucks taking out the hood, tire and rim, not to forget the axle damage. That truck was down for a month, the driver lost two loads he scheduled so we sued and got all the money, I know the insurance company raised the premiums for the owner of the truck.
No matter what, the blame sits ONLY with the driver, no one else.chris8888, bryan21384, Savor the Flavor and 1 other person Thank this. -
Now, that being said here are the flaws with your theory:
1) YOU pay for the lawyer. Lawyer fees arent recoverable (according to MY lawyer anyways).
2) "downtime" isnt recoverable. See above.
3) There is no cost for moving the truck. If you choose to get a tow, then thats your choice, your cost. The loss of a mirror doesnt make a truck immobile.
4) The lawsuit for a mirror would be in small claims court since its under $5k.
5) And lastly, since it would go through my insurance company, I wouldnt see ANY of this since my insurance company would be handling it...
You would run up a ton of expenses, all of which you would have to pay yourself and then HOPE to get covered, or you can submit a claim for a mirror? Which makes more sense? Its why you have insurance. Because #### happens...Geekonthestreet Thanks this. -
Why in the #### are y'all making me agree with Ridge?
When PTL put a hole in my hood my company got paid for the repairs plus charge for late delivery and the dead head to the house for me. When one of our yard jockeys lost focus and rammed their mirror into an Abbyland reefer unit cracking the access door, WE paid for them to drive the unit to THEIR facility for repairs. The kicker is that the trailer was loaded with THEIR product going to THEIR facility. So why did we pay for them to haul their freight to where it was going? Because we could have fought it in court and lost so it's cheaper to just pay it.
Lack of a mirror is a FMCSA citation, so a tow is merited. Down time is recoverable. Legal costs are recoverable, even if they aren't - $4,000 for a lawyer to recover $5,000 and you're still $1,000 ahead. And even if your insurance company is handling it you'll see it on your increased premiums.
Stuff happens, but that mirror could sink a company. Say Bob's Transport has a contract that has SEVERE penalties for late deliveries, with exceptions for things outside of their control. If they don't pursue you for hitting their truck they could face penalties that far outstrip the cost of a mirror.bryan21384 Thanks this. -

Now let's talk about getting into a shop for the repair. Last night I inquired about getting my steer brakes replaced at a company shop and was told it would be three days before they got it in. For a brake job, something I could do myself in three hours if I had the tools (which I don't).
And that's before we talk about reporting requirements. When PTL hit me, I had to go "on duty" to report the accident, forcing me to restart my 10 hour break which made me 4 hours late for my appointment. There was no FMCSA defect to my truck, but I couldn't start running until inside the HOS. If you'd like, you can search the Schneider chat room thread to find the "supporting documents" from 7 years ago.bryan21384 Thanks this. -

Now tell me again how a broken mirror is minor and will not hurt the company?Last edited: Oct 16, 2022
