    Cell phone on person( it was in my pocket)
    Seatbelt(was lowered to non reporting ticket)
    No eld manual not knowing how to send eld manual. Windshield wiper inoperable

    Or not having the paper backup logbook ?
    Or not knowing how to use the eld ?

    How did you get so many eld violations ?

    Your situation is Probabaly not as bad as you think

    no accidents and no moving violations on your state MVR is a plus

    and a lot of companies done use the DAC

    if you’re around Atlanta ,There should be some place you can get hired .

    Insurance will be through the roof as an owner-operator, if you can even get it.
    Maybe a few 2nd chance companies can hire you.

    OK. 11 isn't that bad, but lets break this all down.

    First he actually did something good for you, he got you to get the hell out of that company.

    Yep, it seems that way but understand what the company was too lazy in doing for you.

    These are the type of companies I and other fleet owners hate, instead of running a tight ship which takes a lot of work, they are too lazy to ensure as much as they can the driver isn't going to get cited - meaning the company - for problems that are easily fixed on the front end.

    He was, no matter how frustrating it seems, it is better than going to court after an accident where the investigators find these violations. MOST are BS things that he found.

    The first thing you need to do is to respond to the DAC entries by the company, explain that there were no accidents and so on.

    How do they know you had a stretched airline and what is a neck tire? Back tire? Back tire in a ditch is considered an preventable in my company because there isn't an excuse for it, my safety girl (she gave her that title) would have had you on the phone lecturing you on how to drive the truck.

    NOPE, NOT AT ALL, you didn't kill anyone walking on a side walk or t-bone a bus full of kids - both of those actually happened and the driver is still driving today.

    SO?

    There are a lot of carriers out there, China can help you with that. they may not be great but they will get you rolling. Many, like me, don't put any credence in DAC reports, I hate them because they are abused - I have one driver who has a horrible report with all kinds of things on it in retaliation from his last company who was owned by a father and son who just beat the hell out of the drivers and shorting them on pay. It had things like load abandonment and ten accidents, I know he didn't do any of these things and was a very good driver so he came here.

    You have 6 months of experience, no way would I even consider that just to get on the road. Be a driver for a few years, learn the real business behind the truck, and then consider it.

    This is my biggest peeves with drivers, saw this crap this morning when I was on the freeway. No one behind me until I had a moron driver in a long nose riding my ***** with his brights on while I was doing 75 in the center lane. He was within a couple feet of my rear, and this went on until right we blew right by a cop sitting on the on ramp watching it, and the cop ended up pulling him over and having me stop to talk to the cop about his behavior. Dash cams rule!!

    SO learn how to pace yourself behind the another vehicle with some distance. No need to crowd anyone.

    I don't buy this one, fight it.

    Another peeve, it is so simple, wear the belt. This is where my insurance company will see it and tell me you would cost me 5% more and it will increase if you have a ticket from it so wear the belt.

    This one is completely on the company. When this ELD crap started I had to "train" the drivers on everything they needed to know about the ELD and have them sign off that they know how to do specific operations. When the ELD functions changed, they are contacted one by one and someone goes through the changes with them. NO excuse for a driver or a company to know how it works. The company is responsible for you knowing about it, this is on them.

    I would blame you for it if you didn't report is as part of the pre-trip - at least check it every once in a while but then if you did, it is on them.

    This is so simple of a fix but it sounds like you were driving a POS truck.

    You'll find work, it may be frustrating but remember there are companies that will hire you by ignoring that DAC report.[/QUOTE]
