Yes you will get a ticket if you are over the 12,34,34 weigh distribution for the interstate unless you have permits. Even with permits IF you don't have axles rated for that weight and have a PITA inspector you'll get a ticket for that. You can have 40K on a spread or tri axle setup.

Also, some states allow higher limits if you stay off of the interstate. TN allows 40 on a tandem axle and 20 on the steer, so having a heavier rated axle helps in places like that.

Alabama allows 82,500 on a quad-axle, 88,000 on five axles, 92,400 on 6 axles. These weights are for secondary and county roads unless otherwise marked.
Some of us run the interstate with these weights because it's safer than a two lane where you have no where to go when some inbred ignorant Richard cranium pulls out when your 100 feet from them traveling at 55 mph, then stops in a 1000 feet to turn left against traffic.
