any company that pays 1099 and no ins

    Keeps money in those owners' pockets. That's why. As long as the laws ain't being enforced, they'll continue to do this. They'll always have troubled or desperate drivers with bad records.

    I don't get why the 1099 scams are even a thing. I mean, they're so danged open about it, obviously illegal or not. They'll even be blatant about it through a phone call with a total stranger. All an investigator has to do is inquire about a job, and BOOM! The company rep effectively confesses. It wouldn't be hard in the LEAST for the IRS to prove fraud. I'd bet it could be done in less than 12 hours, in fact.

    Why is this allowed when it'd be so easy to enforce??

    IMO I don’t think there necessarily trying to screw drivers it’s the same thing as a lease purchase really.A lot of Truck load companies operate on a small profit margin they try to cut there costs.lease purchase and 1099 companies use this to do away with cost of employee cost like they don’t have to match social security tax and they don’t pay workers comp insurance,1099 as well as L/P shifts all that cost to the driver.

    I understand the reasons it is done. However, the federal tax code is very clear about this. 1099 is for Independent Contractors, not employees. As such, without the EASY enforcement of those laws, 1099 is used to take advantage more often than not. Used this way, it's purely a tax dodge for the company - blatantly illegal. It's time to crack down hard when so many are openly advertising a non-existent 1099 EMPLOYEE position.

    Now, couple that offer with some type of lease, all covered. But...this is almost never the case.

    One of my lessors has a 1099 employee who says getting paid 1099 is waaaaaaay better than W2….. I tried to explain but it fell or deaf ears.

    Well sure.. until he's on here cause "he got screwed" "he got hurt", "he didn't know" etc etc etc
