State disability Insurance, question for anyone who's been down that road

    I've been a driver for over a year with a national carrier. I live in NJ but my work week begins in PA and I drive over Northeast and Mid-Atlantic. I had an aortic dissection in December and have been unable to drive (or do much of anything) since then. I applied for NJ temporary disability insurance (my employer takes out an amount of each paycheck for it). One of the questions I received back from NJ is what percentage of my work is not in NJ, implying disability insurance is only for NJ workers. This doesn't make sense for drivers and I'm not sure how to respond. Since I'm paying for short term disability in NJ, I would think that is all they care about (?). Has anyone faced this? And I'm talking state disability, not your short term disability thru your health insurance (which I didn't sign up for). TIA.

    I would tell them 100%. Otherwise they will surely screw you out of some of the money you have coming.

    i live in RI...

    my job started in MA

    i got hurt in MA

    i went on workman's comp/disability. no issues.

    you're a NJ resident, period. should be no issues

    lawyer up, he/she will see to it, you get your payments.

    mine did.

    Where is your employer based. I would think that has a lot to do with it.

    Wisconsin, but I've never worked there and don't pay any taxes to the state. But that was one of the states the NJ govt. wanted to know what % of my work was there.

    Put 100%. Jersey is a pain the butt. You might want to call a lawyer.

    I think all states have an exemption for truck driver on their disability insurance.

    You work in NJ, you travel to PA but that's it.

    This is where the state thinks they can make up the rules to apply to individual cases.

    i don't think so...one employer i had was in NJ for one injury i had, and i live in RI, but got hurt in NY

    another employer i had, was in GA, but i worked out of MA, got hurt in MA, but BOTH injuries were under RI disability claims...

    so from only what i have experienced, it must be the state you live in..??? where the claims are accepted..

    again, the o/p needs to get a lawyer that specializes in work injuries, for the final say.
