So if a pedestrian is jay walking it's ok to run them over even if you can clearly see them? That's the general consensus you guys are pushing here. Essentially because these moronic workers failed to put a thousand signs up the driver gets a free pass to kill one of them.

I avoid a nightmare on 95 in Florida a few years back. Middle of the night “two right lanes closed” so said all the signs. Barrels set up accordingly to what the signs said.
Guess what! The workers were in the left lane and the barrels sent me on a collision course with them. Luckily I was paying attention and luckily no one ended up under my trailer while the idiots fixed the problem.
Another recent one. Left lane closed and there was a message board sitting in the travel lane completely dark no message showing. Luckily I was doing the posted speed and was able to swerve out of the way. -

I watched it. It was not barrier’d off, the guy on the ground was not waving his hands to stop and the other workers were admittedly in the truck. We don’t know if the sun was in his eyes and for sure he was watching that right mirror. This is all over the construction company.

Of course if you see the jaywalking idiot it’s not okay (should be) to just run them over. If you do run them over because you didn’t see them then no one will really care -
Utility workers of all people should know exactly how tall a truck is and that it's literally just a matter of time before one drives by. If there is a law regulating the height of power lines that cross over public roads for exactly that reason, and these fine gentlemen who install them for a living don't bother placing their bucket at at least the same height, or take other precauting such as closing off the street, then they were asking for it. If there was no warning about the height and the street isn't closed to trucks, then that's not on the driver. If a truck isn't liable for taking down a wire that has tagged below 13'6, why is this any different? The bucket is up pretty high. Well over windshield height. He probably figured that surely they checked to make sure this couldn't happen, right? Luckily nobody seems to have been seriously hurt. But, I would say the lead man on that line crew has some explaining to do.
