I'm LTL driver that drives within a 100 mile radius. My question is this.....if Im already at 12 hours of combined on-duty and driving hours, and a company wants to send me on a run that will exceed my 14-hours of service, is that legal?? I would be driving going into my 15th hour, but still not exceeding my 11 hours of drive time.

Radius miles are irrelevant. If you return to your same terminal each day and go off duty for 10 hours, you may exceed the 14 once each week. Unless you get a 34, then you can exceed once per each 34 reset. This was discussed ad nauseum in a different thread...I'll try to track that down.

Its really confusing, I was reading the rules on the Federal DOT website. It seemed to me that if your a property carrying CMV driver, then your max HOS is 14 consecutive hours.

If you can read and understand FMCSR 395.3, then you should be able to read and understand FMCSR 395.1 (o) which is where you will find your exemption.
I can lead you to it, but I can't understand it for you. You have to do that yourself. -
#1 Cannot exceed 11 hours driving
#2 On-duty must not exceed 16 hrs
#3 Must return to home terminal within the 16
#4 Must be given 10 hrs off before next on-duty status
A hotel is not your home terminal, neither is the sleeper.
The 10 hrs off is a real issue as most dispatch have short term memory loss and expect you back at work at 6AM after running you til the wee hours the night before.Injun Thanks this. -
Again, Injun nailed it! I never had to use it because I run overnight on mondays, after coming off a reset(all weekend off).
It's a BS rule as far as I am concered for local drivers. Hopefully, the way it looks, we may lose that excemption with the new HOS. -

I drive within 200 miles of home and I have to use the 16 hour rule about every other week. Without it I would have to stay in Kemmerer WY. Who wants to stay over night one hour from home?
