companies willing to give a chance

    In my past i have failed a non dot drug test and i am getting one door after another closed in my face. i know what i did was wrong but isnt there even one trucking company that is willing to give a guy who made a bad decision in 2009 a chance. i was hoping that someone would know of a truck driving company that wont shut me down for something bad i did 2 years ago. i have never been convicted, arrested, or charged with anything but a seatbelt ticket once which i paid. i can piss clean till the cows come home now i just need to find a trucking company willing to overlook this issue. if anyone can help please do. thanks a bunch everyone.

    how is it you are being denied in the first place..??

    did you tell them about it..??

    if a non DOT drug test, that means NOT a trucking company, right..??

    was your employer a member of DAC.?

    Drugs and trucking do not mix. ANY company that would hire a driver who failed a drug test opens themselves up to a significant liability...ESPECIALLY if you turn out to not be as "clean" as you claim to be after you have an incident.

    ...and especially with it being so recent, why should they take that risk?

    Actions have consequences....and this is a very unforgiving industry. It'll be 5-10 years minimum before you will find anyone who might be willing to take a chance on you....and even then, you'll have difficulty finding work. Many companies won't hire you if you have EVER had a DUI or failed a drug test.

    i totally agree with the drug issue and such, but his drug test was a non DOT, so i want to know what industry did he work for, and how anyone found out?

    his company "could be" a member of DAC

    he could have just admitted to it on applications.

    someone reported it to someplace...but he does not elaborate.

    Prospective employers are required to contact former employers as part of the driver file they are required to keep on all of their drivers.

    If the answer pursuant to § 383.35(c)(3) for a prior job is "failed a drug test", then he's either got to admit on the application that he was fired after failing a drug test, or he lies on the application and hopes his previous employer does not state "failed a drug test" as the reason for termination when they are contacted to verify his previous employment.

    If you lie on the application, even if you get the job initially, if the truth EVER finds its way out, you will likely be fired....especially if telling the truth would have made you ineligible for hire. And when that company is contacted to verify your employment with them, you can be certain they will say "lied on his application" as the reason, which will cause your new prospective employer to look at your application with an increased level of scrutiny.

    Lying never really gets you anywhere.

    by law, an employer is only supposed to give information stating your employment dates....and if rehire-able or not, so his company may be saying too much. yes, lying is not what one would want to do, that's a given. but TMI from former employers can be stopped.

    § 391 deals with the driver file.

    § 391.21(b)(10)(iii) also states that a reason for leaving a former employer needs to be given on the application.

    § 391.23(e) is detailing employment verification checks....and although specific to DOT regulated safety sensitive jobs, the employment verification form most companies fax/mail out usually involves a section for the previous employer to report any failed drug or alcohol tests. It is up to the previous employer to read the form close enough to realize he doesn't necessarily have to fill out that section if the employee did not fall under the drug & alcohol testing requirements of 49 CFR part 40. This same form will typically have the applicant's signature on it stating that they are allowing this information to be released by the previous employer. In other words, if the previous employer doesn't read the form all that closely (or doesn't understand it completely), but notices the release signed by the applicant, more often than not they would include the information about any drug & alcohol testing they may have done.

    Whether they need to include the information or not, you signed on the dotted line authorizing your previous employers to release that information....whether or not they do is up to their understanding of what exactly is required of them vs. their willingness to submit whatever information is asked for.

    Everyone will hate this idea, but do a poxy application with an employeer you dont want to work for like cre, or any other worthless trucking company. If one has a yard close to your home that would be best. This time lie on your application about it. Go threw the whole process, but at last minut before you get into truck tell them your wife daughter son father ets.. is sick, better excuse would be better you know what I mean. Use a good excuse that will delay your ability to drive for them for a week and a half to two weeks. A week and a half all the info will have been given to them and gone over. If you get a call saying they will not hire you becouse a failed drug test then you know, without being actually terminated from a job, I think lol. If they say nothing tell them you changed your mind, you dont want to work for a worthless trucking company.

    Worst case scenerio just PM one of the many swift recruiters floating around this board. Swift will hire anybody capable of fogging a mirror, that and CDL is there only two requirments to work for them.

    not sure if it works for all states--but i think you are allowed to see what the former employer has written about you--and you are allowed to repute it as well
