Hi, I was stopped at a railroad crossing( driving a company tractor trailer )because I had a placarded trailer.
A 4 wheeler did not notice me stopped with my 4 way flashers and brake lights on in daylight on a clear sunny day and rear ended me at about 60MPH causing the trailer frame to bend and folding under the ICC bumper.
I do not feel like I was hurt at the time.
I wonder how this accident is going to impact my CSA record as I was not at fault.
The State police that did the accident report gave the driver that hit me several tickets.I received none and was not at fault.
I'm getting about 10 letters a day from lawyers now.....![]()

It will be a DOT Recordable, but a non prevetalbe to you. The important part is its non preventable.
Get and keep a copy of the police report. If you ever go to get a job elsewhere it will be very handy to have to show your perspective employer.

Often wonder how this sort of thing would play out.
Been hauling a haz mat once a week lately, and have to run a road that I feel is way too busy for my railroad crossing stop. The way I see it, it's only a matter of time before someone runs into the back of me.123456 Thanks this. -
DOT reportable if a vehicle was towed away, if there was an injury or fatality, or if a citation was issued.
Let's see rear-ended at 60 MPH, I bet the car was towed away and the driver was most likely injured!
Also I believe the OP mentioned that the 4 wheeler was ticketed multiple times.
This was not my idea, but comes from Sammycat, who is NOT a driver, but a Registered Nurse.
On a sidebar, all drivers know that a placarded truck must stop at railroad tracks. But most 4 wheelers don't. Perhaps in addition to the placard, we might want to put a sign on the back of the truck that says "this vehicle stops at all railroad tracks."!!! -

Ohh. it gets better. The vehicle that hit me was being towed by another with a chain-no towbar. They were taking it to the scrap yard.
The towing vehicle managed to miss me but the chain broke and the vehicle in tow rear ended me-2 people in that one who saw $$$ signs because of my truck changed their story from "no we are ok" to my " my back hurts". In fact the one driving the towed vehicle had a suspended license....the state police were not impressed.
