I don't think that goes into effect until July 1 2013, does it?

    ZippyNH Thanks this.

Please provide a link to an offical source explaining how extended loading/unloading time can count as that break.

The best way I found was to use that logbook dot com website and download the eclipse logbook software for free, input your times and breaks, etc, it shows a red line where you cannot drive past. I log 12 and 13 hours of driving in 24 hour period all the time, no violations.

I'm guessing it would count if you log at least 30 min in the sleeper/off duty while loading/unloading, provided that time occurs within that 8 hour window. Nothing I have seen thus far says it wouldn't.

    *2. When is compliance required?
Compliance with the § 395.2 definition of "on-duty time" and the § 395.1(d) "oilfield" provisions, when applicable, is required as of February 27, 2012. Compliance with all other provisions is required no later than July 1, 2013. Because the new rule is more restrictive than the current rule, drivers and carriers may comply at any time after the effective date of the rule; in other words, if they are in compliance with the new rules, they will also be in compliance with the current rules.

You only have to show one pre-trip a day. drive 11 take 10 off drive again, drive 8 take ten off drive again, drive 7 take 10 off drive again. The total driving hours are the same for the last two. the 11 and 10 cycle will be less the thirty min break.

Hopefully the new 34hr restart and 30 min. break provision get taken down in court before 2013.
